BW Legal County Court Claim Form

  • Folks,
Wish you all a very happy new year.
I wanted to update you, that since sending out the Defence  exactly a month ago, the only 2 communications I have received are:
    1. The automated acknowledgement of defence email from CCBCAQ, within a few mins of sending out the defence. It went on to state that due to Covid situation things are taking longer etc.
    2. Then, I received a letter from BW Legal in the new year on the 4th Jan 21, which was dated 29th Dec 20, it stated the usual stuff around - its not too late and that I can still pay the amount etc.
Apart from these, it has been a complete radio silence. I downloaded the DQ form myself back in Dec but didnt do anything with it yet. I wanted some guidance on whether I should pre-emptively send out the DQ to CCBCAQ or wait to see what BW Legal do next? I am a little bit stressed that I may have missed some crucial step.
Thanks again for your guidance in advance.

    Best Regards
    Sam

You need to send the DQ in accordance with whatever the court has told you to do, as in the guide to court.

Well done on downloading one. You must never use the one provided by the scammers.

Sometimes the DQ from the court comes late, or doesn't come at all, so check the guide to court in the NEWBIES and re-check documentation/emails from the court. There is a lot of stuff, including dates when docs need to be submitted, buried in the small print, often on the back of a court order/instruction.

If in doubt, send it anyway. If you find you are late in sending it, add a comment that you were expecting to receive one from the court but it has not arrived.

Best to check the MCOL site first , daily if necessary !

When it says a DQ has been posted out , email your completed DQ to that ccbcaq email address , but not before it's showing as posted , no need to wait for the post to arrive. Don't expect this saga to race , it's like a slow , slow shuffle

The mcol site should show defence submitted , then they wait for up to a month for the claimant to state they are proceeding , before they send the DQ out , whereas you seem to think it's all over quickly

Once your DQ has been submitted , send a copy to the claimant , then it will be several months before you hear from your nominated court , so again , it's snails pace , especially with covid19 , like waiting for a routine operation at your local hospital , you could wait months !!

    Many Thanks Redx, Fruitcake, Nosferatu.
I checked MCOL and in the 'Response History' grid under the last column named 'Latest Document'  it says 'Acknowledgement of Service'.
Is this simply because the CCBC is yet to process the Defence email from me and update this 'Defence ', which given the Covid situation coupled with the Christmas holidays I presume must take a while. Hope this wasn't this something I was supposed to somehow toggle to indicate the submission of Defence.

It does seem rather a long time.
Maybe give the CCBC a ring and ask them what's going on.

Look after that automatic email reply you received when filing your Defence - just in case.

    Thanks Keith will do.
I checked my spam folder as well but apart from that Auto Acknowledgement from CCBC, nothing else shows up anywhere in my mailbox.
On the MCOL page, there is a 'Start Defence' button, may I please ask, if this was something I was meant to click or was the email based Defence submission the only thing I was supposed to do. Apologies if I am missing something obvious.

Definitely do not touch that defence box , don't ruin it now !!

If the CCBC have not input the defence , then they haven't contacted the claimant so are not at the DQ stage yet either

So as mentioned above , contact the CCBC by phone , also keep that auto acknowledgment safe as it's your proof of receipt by the CCBC

Consider the MCOL website as read only after the AOS was done , there is nothing to be done , only to read and check progress. The AOS was completed on there , after which it's email and phone calls only , nothing else
