ADVICE NEEDED PLEASE/ REDUNDANCY NOTICE PERIOD

    What do you mean by redundancy period. 

  • I believe that the whole Consultation process has not been followed correctly.
    For example, of the three consultation meetings I have only had representation on one occasion, the second consultation, and this was after I complained about not being represented at the first consultation.
    The Company had advised that they would be providing a chosen representative,.
    And subsequently named the person who was to represent me.
    As stated above this rep only made one appearance on my behalf.
    The rep has since stated that she could not represent me because the Company were not allowing her to be released from her place of employment.
    Any help as always, would be greatly appreciated.

    Representation is part of collective consultation. 
    Either union or elected reps. 

    For individual consultation anyone you want to attend should be your choice  usually union or colleague.
    In some circumstances external like a solicitor may be accepted by the company.

    It is your responsibility to arrange that person. 

    How many if 20 or more collective consultation should be happening. 





  • The Company offered an elected rep for those not part of a union, which was the case for me and others.
    What I am trying to establish is was it against protocol for the firm to deny me representation on Consultation 1 and 3,
    I would have assumed not being offered when requested being represented is not how the Company should have acted.

    It is up to you to say you want someone at your individual consultations, can be anyone not just one of the elected representatives that get involved in the collective consultations.

    if you were happy with the person they said you could use then if they were not available you should have had the meeting rearranged  or got someone else to go with you.

    You should deal with these elected reps and be providing them with the feedback on the process they have a responsibility to everyone involved.

     When I asked the elected rep to represent me she advised me that she would not be able to do this.
    When I asked for the reason she told me that the firm were not prepared for her to attend because of her work commitments.!
    The only time I had a rep was on the 2nd consultation when I made a formal complaint to the company for being afforded that right at the 1st Consultation.
    I was also denied to rely on the elected rep on consultation 3.
    Surely this cannot be right giving the extreme circumstances at that time.

    Did you ask for someone to attend the initial consultation and was that refused?
    Did you ask to delay the  3rd consultation while you found someone else to accompany you?

    The rep could complain they have not been given reasonable paid time off to do the job of rep.

    That is correct I ask if the elected rep attend the initial meeting but this was refused because the Company were not prepared to pay for the rep to attend.
    The same scenario happened at the third consultation whereby the company refused to allow the elected rep time off to attend.
    Evidently the only time this process was adopted was for the second consultation when someone from HR attended the meeting and subsequently helped me.
    However but for me making a formal complaint that would not have been the case.
    The whole consultation process was shambolic imo.




  • There is no statutory right to be accompanied to a redundancy consultation meeting.   That doesn’t prevent the employer from agreeing to it of course.  The final meeting that could result in dismissal should allow for a union rep or colleague (although I’m not sure it’s a statutory right).
