    If the judge asks you a question then you must answer truthfully. So ask yourself - "if the judge asks me if I was the driver, what am I going to say?" If you weren't the driver then you cannot say for sure what happened - you can only speculate or transmit what the driver told you (thus it is hearsay).

    I would just say that you were not the driver, and explain what sort of car park it is from your local knowledge, and not say anything about what the driver did or didn't do because that would be hearsay at best.

    Thanks mate, I’ve registered my defence, they’ve got till the 12th to reply but haven’t had anything yet! Have you had anything back at all?

  • Hi guys, Claimant has now returned their directions questionnaire, so be publishing my next WS draft in the next few days for your critique.  
    A question that's been on my mind though.....Am I right to assume that the Judge will have read my Defence & Witness Statement prior to the hearing?

    No , because you haven't done your DQ supplied by the CCBC yet , and currently no court or judge is involved

    Check MCOL website to see if they have posted out their blank DQ yet , that is your next action

    Your WS plus Exhibits plus summary costs assessment isn't due for several months , which is usually due maybe 2 week's before the hearing. A judge may have only read the case a few days before the hearing , or on the day , so never , never assume anything , think of how assume is made up , 3*syllables making one word

    They should have.
