But almost none of it in #3 is likely to be true of your Particulars of Claim.  Read my words and see if it is true of your POC.

Op - your job is to 7nderstamd your defence
3 almost certainly does not apply to you. You must have attention to detail because you're goi got be signing this under penalty of perjury. You should take this as seriously as that crime.
  • Ok thanks both. I'll remove 3 in its entirety, including 3.1 yes?
I'm not used to the language used & legal jargon. I appreciate I need to try and understand it the best I can, but I'm not confident removing text that I feel possibly doesn't apply in case maybe I do need it in there! But at the same time obviously don't want to get done for perjury! Rock & hard place. Eek.

Obviously you write your OWN #3 because ay the moment you have told the Judge ZERO, nothing about the car park or anything.

How much simpler can I make it than just leaving people to write their own facts in #2 and #3.  Why is this like puling teeth so often?

  • Why do I need to tell them about the car park? I wasn't driving, which I've stated in #2 so assume no liability. So what more is there to say?

What facts do you know, from local knowledge or from going to look, or from what the driver told you?

  • I know it's an NCP retail car park. There is signage & pay & display machines. The driver was in a rush, forgot to pay, parked up for less than ten minutes and left. No ticket on windscreen, but caught on APNR camera hence letters in the post.

The reason - and it's pretty obvious - is that it sets the scene for the judge readi g your defence. They e got no clue whatsoever about this site. Tell them.

OK so the defence facts are what you said, to tell the Judge about it, and that the driver (you? - admit to driving if it was you) left without accepting the contract and within the BPA Grace periods.  Read them (the right year Code of Practice).
