Debt Recovery Plus / CP Plus Parking Charge

    In regards to a matter with CP Plus can you erase all my old data and replace it with my new address for service, which is as follows;

    Proof of the new address is provided by attached recent utility bills.

     

    I would also like to request a Subject access request ( Data Protection Act 2018 / General Data Protection Regulations (GDPR) )

    Please supply the data about me that I am entitled to under data protection law relating to myself. This must include:

     

    • All photos
    • All correspondence, in any form
    • A list of all outstanding PCN’s
    • Any further data

     

    If you need any more data from me to confirm my identity please let me know as soon as possible. It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month.

  • Got the info together and am going to email the DPO at nexus with the above ^^. Think it looks good, only question was about getting the PDT data. It was an automatic VRN system, there was an option to pay on a meter (also by web, phone, etc) so not 100% sure whether it is worth asking for that?

    Small point; you submit a Subject Access Request, you can't request a request.  I doubt you will get ALL photos, only those relating to you or your vehicle.  Don't offer to send them any more ID, your V5C should suffice or, if you've moved and the address is different, a copy of the PCN and maybe council tax bill or utilities bill for where you live now.  NO driving licence of passport!

  • Haven't said a word about who was driving so yes hopefully. I have a pic of the vehicle entering the car park, it is only small but I doubt even with better resolution you could see who was driving.

  • As an update, I appealed using the template in the newbies thread, as follows;

    Re PCN number: xxxx I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner. There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle. If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it. If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. The keepers name and address are listed below; 

    Just received a reply today and SUCCESS! they have cancelled it.

    Dear Sir/Madam,
    Thank you for your correspondence relating to your Parking Charge.
    Further to your representations, we have investigated your claims and can confirm that your Charge has subsequently been cancelled in full and no further action will be taken.
    Please disregard any letters received that predate this email.
