Debt Recovery Plus / CP Plus Parking Charge

Hi all,
I received a letter from Debt Recovery Plus asking for a demand of payment of £170 due to an unpaid parking charge relating to a charge by CP Plus car park in Worthing. This is the first letter I have received about the charge. They say that notices about the charge were sent to my previous address and went unanswered, and that this was the address they have obtained from the DVLA. Clearly they are using old information as the charge was issued on the 24/07/2020 and I had updated the DVLA with my new address on the 26/04/2020.
I want to appeal the charge and was going send the template appeals letter in the NEWBIES thread. However, should I raise the issue about the address error and that I never received the initial letters, and hence get them to re-start the process as such and offer lower repayment options, before I start the appeals process? or does this fact not matter.

Too late for any appeals , you cannot get the process restarted !!

Email a data rectification notice to c p plus or is it nexus group now ?
They are correct that they accessed the DVLA for details so get your V5C out , check it's been updated , check the date it was updated , check that your current address is on it

As Redx says above ..... BUT, leave DRP to drown in their own sorrow, they lied, you don't owe £170, it's a scam and you never pay them or indeed contact them, they are simply pointless clowns with no power3

You could try a late appeal, stating that the keeper moved and didn't get the original PCN as a result. The worst that can happen is that you waste a few minutes copying and pasting the template from the NEWBIES and it gets rejected.
Was the original charge date in July, or was that the date of the DRP bog paper? The parking company will use the address they are given by the DVLA, so as advised above, you need to check that the new address is on the V5C, and that it was correct before the date of the alleged event.
If the address was changed after the date of the alleged event, then they have used the correct address.
You should write a rectification notice to the DPO of the PPC telling them to erase your old data and replace it with the keeper's new address for service.
If the keeper doesn't have the original PCN, then send an SAR as per the NEWBIES to the DPO as well, requesting all personal data about the keeper held by the PPC. Include a copy of the V5C with the correct address or two redacted utility bills as proof of ID.

Ye, I called the DVLA to double check that my address had been correctly updated and they had it down as the 26/04/2020, which is on my driving licence to be fair, so it was definitely up to date before the date of the ticket on the 24/07/2020. I got the letter from DRP over the weekend.
I'm not quite clear on what sending the data rectification notice to them will achieve, given that I cannot appeal?
I read post 4 on the newbies thread. Is that, and beamerguy, just saying to ignore it all then? I have no plans on paying them a bean, but after having bad credit rating for ages and having just managed it get it back up to a decent level, I'd really rather not have anything affected it, else I will tear every CP Plus and DRP person limb from limb with more than a twinkle in my eye.0 -
It gives the claimant the correct address and you also state the date the V5C was changed too , adding a copy of it as proof of I D plus proof of the date change
You mentioned the driving licence above , but both have to be done , so I mentioned the V5C , not the driving licence , the driving licence is irrelevant
Beaneeguy did not say ignore it all , he said ignore drpl , ignore the debt collector , a big difference
You must ask yourself why the old address was used in the first place , given that the DVLA gave it to them after the date of the PCN !! That is what Poirot needs answering3 -
Okay, I didn't realise there could be a distinct difference between when the address on the driving licence and the V5C would be updated. I'll check this tomorrow and update.

We agree , it should be one data subject change , but currently it's 2 separate transactions , so many people do the driving licence and not the V5C , then they end up here , like you
Think about it , why would the DVLA give out the old V5C address ??

The date that a V5c is updated is shown on the document itself.
At the bottom of the second page it says:
Official use only. Do not write in this space.
Immediately below that is an eleven digit number, the document reference number as seen on the front of the document, followed by a date dd mm yy.
That date is when the Vehicle Registration Document was last updated.

Ahh !!!!!!, so you learn something new everyday, didn't realise the licence and V5C addresses need updating separately, so yeah it was in my old address. Maybe I should have done a bit more googling.
I had assumed that DVLA had given them old details, or they used some cheap third party company, but this is evidently not the case.
Ignoring the letters from the scum and I will do a bit go googling as to where to go from here. Certainly not paying £170 for the first haircut I had after lockdown!0 -
