            Just an update:
I posted the witness statement to both the court and ELMS (The Legal representative of Excel Parking). I sent them first class with proof of postage. I have also emailed the court with a copy of the statement.
Shall I also email ELMS?

            Covid has introduced flexibility. I would always send electronically rather than traditional snail mail. Belt and braces time - where you've Royal Mailed, send an duplicate electronic version as well. Cover all avenues. Get it wrong, you lose.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

            If the scammers WS arrives late, as well as mentioning it to the court, bring it up as a preliminary matter before the hearing starts, and post it here anyway. You can then send a supplementary WS addressing their WS, explaining it arrived too late for you to do this before the submission deadline.
Have you been checking your junk/spam box in case it has sneaked in without you realising it?
If not, don't be surprised if it arrives at 15.55 pm on the 24th.

Also, they have acknowledged receipt of my WS.1 - 
            It is useful in so far as to aszk the court to strike it if it arrives late , or to complain to the court about it being late !!
A court order is an order , a deadline is a deadline , but it's up to a judge to decide
It's not like turning up to an easyJet boarding desk after the deadline and being refused to board !! Or the planes gone !2 - 
            Update:
24th March was the deadline for both parties to receive a witness statement. I have sent mine on time to both the court and ELMS but they missed the deadline.
Today, I have received a "Notice of discontinuance" from ELMS.

Were you claiming extra-ordinary costs, like for unreasonable behaviour (a very high bar to get over - think more pole vault than hurdle)?Please note, we are not a legal advice forum.
