Yes your health and all relevant circumstances would be taken into account.
It is only the standard allowance that is subject to sanction, not housing or child elements.
The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

I just wondered how that would work once they take my partners earning into account and how they would work that out

If they did sanction, what part of the claim do they sanction first if you have
    Adult, child and housing elements

As has previously been advised a few times in the thread, with a fit note from your GP it's very unlikely that you'll be sanctioned.

If you dwp deem you fit after an assessment, can you try for lwc on universal credit, I have read you can't reapply for Esa unless you condition gets worse

The assessment for ESA and UC is the same and if you are assessed for one it should be used for the other.

If you deemed fit for work can you try for lwc again, as if deemed fit under esa you can't try again unless your condition is worse

You will need a change in your health condition in order to request another assessment.

Is that the same for lwc also
Obviously it must be very hard with mental health because it can change all the time,

The process and criteria for a Work Capability Assessment is exactly the same whether it's for ESA or UC. They are supposed to take into account fluctuating conditions and assess you on that basis in the first place. I'm not exactly sure what the guidelines are about how significant the change has to be, but either way the same applies to both ESA and UC.

LCW is the UC term for what's termed the WRAG under ESA.
LCWRA is the UC term for what is the Support Group under ESA.
The WCA is exactly the same for both benefits.
