Would the ECA2010 override the parking operators terms and conditions?
It's more a point of 'service providers' needing to comply with the Act. They can't concoct T&Cs to avoid it.
What about Frustration of Contract? Given that the renewal BB was probably delayed (as most things are at the moment) he would not have been able to display the blue badge.
And by extension ....... not having the right change/money in my pocket to purchase a ticket - frustration of contract?

I'm afraid that without seeing an actual transcript of the hearing, and all the evidence presented by both sides, assumptions based on sympathy aren't going to get very far. Even if appealed, all this is likely to result in is a cancellation of the £150 judgment.

But an EA2010 claim really drags in both principal and agent and the quantum commences at £500. The ensuing publicity will also be much more damaging than any quietly reversed judgment.

If you're on the emailing trail, why not send one to Helen Dolphin of DMUK (similarly severely disabled and a wheelchair user) and ask if she will help the motorist to commence EA2010 action against the PPC and landowner.

Oh, by the way, she is the darling of the IPC who have funded some of her organisation's activities.  Oh, and also by the way, she's one of SRS's mates too, his website bearing the
    imprimatur of DMUK.

Let's see where her principles lie!

SRS showing the imprimatur of DMUK on his website makes him a total hypocrite. He should be made to remove it.

I can think of many more words to describe SRA but not for this forum.

His time will come, it's started already ... DVLA confirmed ... down by 80%
It will not improve until well into next year. If he has any car parks in and around Cineworld, oh dear what a shame ..... and more will follow
There won't be new contracts around either.

Looks like he is appealing according to the Star.

Picture of him with Charles and Camilla in the Star.

SRS must have a skin like rhino hide because there will be an outcry over this.

This chap does not look like a pushover to me and I am sure that he can get some big guns on his side.  IMO he should definitely appeal and/or launch a claim for disability discrimination.

I wonder if Prince Harry will add his weight behind this, especially given the military and para-olympic connections? There may even be a Netflix opportunity for him and Meg to exploit explore?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The parking attendant who gave the ticket has opened Pandora's box. The legal department at VCS should have had the common sense to cancel this ticket.

It's a strong possibility that Harry may make some comments about this on social media. They have probably met and spoken to each other. Harry may even help him obtain some legal advice. He does not think twice about suing.

I don't think they will care a hoot, and will play the hard done by parking company. Rules is rules innit. Everyone knows about the blue badge scheme and many think, well, if you don't display one in a disabled space you are in the wrong.
We have enough trouble educating people who have an incentive to be helped, but the masses know nothing of this scamdustry and how it operates.
Sadly I think a lot of judges believe the same thing, and it will take a big case that will be at least persuasive to change that, and will need a lot of publicity for other judges to even know about it.

Having dealt with family members' disability for two decades, I really want something done to protect their rights and the rights of others with disabilities.
