Tesco Bank Credit Card

In July this year, I was looking to purchase a new car. I started the process to buy a new car from Sandicliffe, the car dealer, I believe is nationwide! Anyway, paid the initial deposit of £100 to start the papers. To go straight to subject, after few days I needed to cancel all process to buy the car. 

I contacted the dealer, they weren't quite happy about this but I had my reasons, all I want to recover those 100 pounds, they said I will not have that £100 deposit back as they started to order a new car and the mess was quite big. Alright, I cancel this process in less than 14 days!!!! After a while they stopped to answer to my emails and when I tried to call them, I got the phone call on hold after few minutes of talking, so unprofessional ! 

All this thing was at the end of July, I started to seek advice to my credit card provider, Tesco Bank in this case, as I paid deposit with my Tesco Credit card. I submit a claim in August to recover £100 as I was covered by Section 75! All good, they said I need to till 6 weeks for investigations. These 6 weeks come to an end, I called them they escalated for another 14 days this claim. At the moment, I am pi**ed off, I am frustrated about this situation. 

I am open to listen any advice! Thanks

    Wait the 14 days and/or raise a complaint with the FOS are your options
    Section 75 covers you breach of contract, not for a deposit lost because you changed your mind.

    What did the terms of the sale say would happen to the deposit if you decided to pull out of the agreement? 
  • Byzar  - before this thread goes on and on for page after page of opinions - can you please return here and explain to us what you think the deposit for £100 was for?

    You'll need to check the terms of your agreement to see if your £100 is actually refundable - it's likely it isn't, even if you cancel within the cooling off period. Otherwise nothing else you can do apart from exhausting the Tesco Bank complaints process and escalating to FOS after the appropriate amount of time.

    S75 will get thrown out as you cancelled the contract. So no breech by retailer. Many people fall foul of that one.
    Only option is a chargeback, but that is going to depend on what the T/C are.
    Given it was a face to face purchase there is no 14 day timescale, unlike online.
    If there was any finance you could cancel that in the 14 days, but that does not stop the purchase of the car, just that means of paying for it.

  • the irony is that the OP states they are open to any advice, but obviously only want advice that meets their views. Escalation to FOS will be a waste of time, OP needs to read the contract they signed/ agreed to at the beginning, if this states refundable then happy days and progress with a claim; it almost certainly says that a deposit is non refundable in which case accept the loss and move on, it could have been a lot worse. And maybe consider any future purchases a bit more carefully.

    As the OP has not stated the cost of the NEW car. It may not even fall within the S75 range.

    I'm sorry but this escalating to FOS at every opportunity is getting me angry.
    Why cannot people accept sometimes that they are not right and accept it?
    I probably need to clarify here as upon re-reading I think my point wasn't particularly clear.

    If you read my post you'll note I said to read the terms of their agreement and see if it is refundable. IF (and it's a big if I admit) the deposit is refundable then by all means they should be allowed to complain; escalating to the FOS is appropriate if Tesco drag their feet over a legitimate grievance.

    I don't agree that the deposit is refundable though. And in that instance I certainly agree that escalating to the FOS isn't appropriate. Apologies if it seemed like I was encouraging spurious complaints.

    The OP asked what he could do, and whether he is right or wrong the FOS is always an option. I agree in this instance they would likely side with Tesco.
