CMS with pension via salary sacrifice

Hi all, really hoping that someone has encountered this and can advise - CMS calculations are based on gross income minus pension contributions BUT the problem I’m encountering is that my personal contribution is deducted as a salary sacrifice and so when CMS go to HMRC , they get told the inclusive of pension amount and therefore calculate based on that........and despite me providing all documentation confirming I pay a 5% personal contribution and the pension statements, they refuse to consider it........

Please, please, please, is this correct? Has anyone else dealt with this?

  • It should be taken into account. Have you asked for a mandatory re consideration after you last review point? If still no luck ask to take it to tribunal.
