High st jeweller refusing to refund

  • I think he should have said to me what happens if you decide to part pay for something of your own accord.  That funds  become non refundable no matter what. 

    As the non refundable in instore purchases policy does not relate to my situation in my opinion, ,as I didn't buy anything. 

     He has manipulated the policy, to force me to spend the money in the store,  that is how I feel.  :-/

    I dont even want to go back to spend it.  I told him I didn't want to buy anything else right now,and he said,oh well, xmas is coming, maybe you can buy something for your husband.

    I have to go back to pick up a ring I just paid £170 to be resized.  I will wait for that, then ask for terms and conditions on my 'account'.    He will not get anymore money out if me thats a sure fact.
  • So you've got no evidence you've ordered anything?  You only have a receipt which shows you've paid £100 but doesn't show what it's for?

    Nope it don't show what it's for, and yes all I have is just the receipt for £400.  I thought it was a bit strange, but I didn't question it, as I had spent money already on other things, and was happy.  I just thought, right if I pay that now then there will be less to pay when I come pick the ring up.

    I don't think its an "account" in any banking/credit regulatory sense, it's more akin to a tab at the bar or the old fashioned informal tally account you might have had in the past with the milkman or local greengrocer that you'd settle up at the end of the week/month.

    You gave them £400 to buy a ring, you know you gave them £400 for the ring, they know it's for the ring and any court would know it was for the ring as they aren't stupid enough to think you just go into shops leaving £400 for no reason.

    The £400 is proof a contract for something was formed, as you are breaking the contract you have no right to a refund for an instore purchase.

    Completely agree with first paragraph. So not really a comparison with  buying gift vouchers.
    With regards second paragraph, request to cancel the next day and no expense to the jeweller. It would seem fair for the jeweller to pay this back. Common decency would suggest this. And the OP is a regular customer. 
    Where have good old fashioned values gone?

  • The fact that I left the 400 of my own accord, as no deposit was required makes it a harder pill to Swallow. 

    I wont be taken in again,  I still think I should have been told that it would become non refundable, before I offered.

    They have lost more than they have gained, I wont spend there again after this.
  • The shop aren't seeing it as a deposit though, are they?  They see it as a voluntary first instalment on an in-store purchase that you have made, and because it was in-store you have no right to a "change of mind" refund.

    Whether their view is correct or not, I don't know.  Some posters here seem to think the shop's view is correct but others think that something is "wrong" with the shop's approach - after all, you've paid £400 and got nothing to show for it.  (Well you have - you've got £400 credit to set against your next purchase).

    You say the shop have acknowledged that they've cancelled the order.  I'd go back to them and say that if they've cancelled the order at no cost to themselves, then they haven't really got any justifiable argument for retaining your £400.  Remind them that you had already spent a further £500 earlier that day.  (I assume the £500 you referred to was with the same jeweller?).  If that doesn't get your money back and you're sure you don't want to do business with them again, I'd make a money claim against them.  I'm not certain you'd win but you might as well try.

    Poor customer service and surprised they haven't give you your money back since they haven't incurred any expenses as a result of you handing over some cash. Seems really petty. You'll have to take them to court. Judge will give you your money back.
