They'll all have to do that if the PAS232 goes the right way!

  • While i went round the car park site taking pictures I noticed they have put up some terms and conditions. see the pictures. I have taken, these photos so they can be used in my witness statement. The entrance notice says that they were in and around the car park, yet there was not any at time of alleged contravention. They have put this sign up very recently. Glad I went to look and take the photos. Do you think i have a good  a good case now as this shows the driver  was not in breach of any terms and conditions as there were not any in place at the time.

This sign looks good, doesn't it.
Are you supposed to read it whilst driving in?

Also what if there was several cars behind you getting impatient, while your reading it lol. That sign wasn't even there before. Also if you parked the other end of the car park, you would have to walk 30/40 metres to go and read it, coz that's the only one on the site.

To me that condition does state that the charge includes all recovery Costs.  It states it is to recover parking charges - presumably unpaid tariff? - and so this can't include more. Means they're screwed

Hi Nos, are you referring back to the 5.2 condition on the terms i posted yesterday, coz that's how it reads to myself but the  other guys that commented reckon there is debt charges that can bee added onto the £100 PCN, i assume the £60 add on.
  • Indeed it's how I read it.

I read it that way too. It admits that a parking charge is higher than any loss, to cover the costs (which we know and was confirmed in the Beavis case) but it's good to se that confirmed.

This reading of signs before you enter only has any relevance unless it is a barrier car park. Even then you could not reverse around and exit. You would have to drive around the car park and exit.

You can be fined (rightly) for using a mobile phone whilst driving yet according to the PPC's you should be able to read these signs whilst driving. Sometimes, as in recent cases reading the sign involved stopping on double yellow lines.
