Darren104 said:Hi all,
Could NCP / BW Legal use the following to justify there £60 add on...
BRITISH PARKING ASSOCIATION CODE OF PRACTICE
19 Charges, and terms and conditions
19.9 You should warn drivers that if they delay payment beyond a payment period of 28 days, and you need to take court action or use debt-recovery methods to recover a debt, there may be extra ‘recovery’ charges for debt-recovery action. However, you do not need to say how much these recovery charges are in advance, on your signs or notices.
However, neither the BPA's CoP nor the IPC's can overrule the law.5 -
That is the BPA interpretation , not enshrined in law
We see that extra charge stuck out numerous times in courts , so judges take a different view of the law , I would put my money on a judge winning out against that argument every time. The judge is bound by the law , not the BPA CoP , which is just a set of club rules4 -
Would it still be ok to use Beamerguy's template letter for Bw Legal about the fake £60 add on.

ThanksPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

If you think it will work to achieve your objective(s), then all you will have wasted used is a bit of time in writing. I don't think there is a thread of hope it will succeed, but I'd be delighted to hear of any positive outcome. Please note, we are not a legal advice forum. Isn't it best to try and negotiate a deal now using the protocol that the court has put in place. What would you do in my position?
Wait for the claim. Stop wasting your time at this stage. It is utterly POINTLESS ranting on about the false added £60 at this stage and in fact, if a PPC did remove it then it makes a case slightly harder to argue in court.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi Guys, I have read NCP Ltd Terms and Conditions. Can someone clarify that this term is stating that (the parking charge) includes the estimate of the additional expenses that will incur (including the debt recovery costs) In others words Does the £100 PCN already include the additional amount and debt recovery costs. Cant understand why they make the wording confusing. Thanks.

5.2 If you do not comply with these requirements we may issue you with a Parking Charge Notice requiring you to pay any unpaid parking charge(s), together with an additional amount representing an estimate of the additional expenses we will incur as a result of your non-compliance (including without limitation debt recovery costs) (the “Parking Charge”). Specific details about the Parking Charge payable are available in each Car Park

an additional amount representing an estimate of the additional expenses we will incur as a result of your non-compliance (including without limitation debt recovery costsThat would say to me that they are going to be adding spurious debt management costs!
