Loveholidays hell

Hi! I’m hoping someone can help me out. We stupidly booked a holiday through love holidays a few weeks back (have only paid deposit). Ryanair have emailed and said they have changed the flights and I have 3 options to accept the change, move the holiday or have a refund. As these dates are not suitable for us we have chosen the refund. I have since gone on chat to loveholidays to cancelling the holiday and they’re telling me that’s not possible without paying x amount for the holiday and I still won’t be entitled to a refund for the hotel part of the holiday. I would have gone on the holiday if Ryanair hadn’t changed the flight, I just want to cancel it all and get my deposit back. I paid by debit card, is there anything I can do to get out of paying the holiday and getting the deposit back?

Where is the Holiday ?
Have you got an ATOL Certificate and if so what does it denote in the bottom right hand corner - ie is it a package holiday ?1 -
If it was booked as a package (what does it say on the ATOL certificate?) then you should have discussed Ryanair's proposition with Loveholidays rather than the airline, asserting that it was a significant change, thereby entitling you to a refund of costs incurred for the whole package as it's effectively them cancelling rather than you (a crucial distinction). If Loveholidays aren't playing ball (or if it isn't a package booking) then your card company won't be able to help but your travel insurer may be able to....2

The holiday was to Spain so Ryan air are still sending flights. We have an atol certificate but I thought that’s only for if companies go bust? We booked through love holidays and they booked the flight & hotel for us. The atol certificate says package (multi-contract) sale...

@eskbanker I did discuss this with love holidays and not Ryan air? Loveholidays have said it is my choice to cancel the holiday as Ryanair Have not cancelled the flight and have just changed it.0

What was the proposed change to the flights, i.e. is it significant enough to be categorised as significant by Loveholidays (12 hours I think)?laurenb1993 said:@eskbanker I did discuss this with love holidays and not Ryan air? We were due to fly out 19/11/20 @ 17:40 then they got changed to 20/11/20 @ 15:50 and have since been changed again to depart on 20/11/20 @ 11:35 so defo over 12hrs. It completely changes the dates of the holiday which is now not suitable for useskbanker said:What was the proposed change to the flights, i.e. is it significant enough to be categorised as significant by Loveholidays (12 hours I think)?0 -
In which case, Loveholidays should accept that this is a significant change to the package, which obliges them to offer you the option to cancel for a full refund of all monies paid, under the Package Travel Regulations.laurenb1993 said:

Edit: going back to my earlier comment, if Loveholidays are in breach of their obligations then your card company can help, so if you attempt to claim a full refund and they refuse then you can go for a chargeback.0 -

Sorry another question. Will that still be the case even though they are no longer with abta?eskbanker said:

Yes, their resignation from ABTA doesn't affect their regulatory obligations so they remain obliged to offer you a full refund if they were unable to fly you close enough to the originally agreed schedule - I presume they didn't offer an acceptable alternative flight other than the rescheduled Ryanair one?laurenb1993 said:
