Tenant moved out, but car fines at my address.

    Who is the HCEO working for ?
    Just tell them the person has moved out and show ID if needed. They are nothing to be worried about 
    HCEO have no right to force entry to domestic premises and powers are very limited when it isnt business premises

    Its not your debt. Prove via passport or similar you're not who they're looking for, once proven there's nothing they can do to you or your property. Picture of your car was to check ownership.

    1. Are you owner or a tenant.
    2. I'd send what documents you have to establish X no longer resident
    3. (the important bit) request written confirmation that they will no longer attend or write to the property in connection with the debt.
    4. If 3 above is not complied with, remind them that failure to comply with your lawful request may constitute actionable harassment (Google the case of Ferguson v British Gas)

    Debt collectors cannot force entry, but can push open an open door. Typically they put a boot in the threshold to prevent doors being closed, once opened.  So speak to them on a phone or out the window if you prefer.

    They cannot take any property that, inter alia, does not belong to the debtor, are essential eg bedding or essential to the performance of a trade
  • I dealt with a situation like this recently for a friend.  I/he wrote to the Debt Collector and described the circumstances.  I said that unless the letters stopped immediately I would take further action in  court for breach of GDPR and harassment.  They didn’t stop so I served a summons via moneyclaimonline online (£25 for up to £300). He won £100 by default plus the court fee.  It doesn’t  always happen nicely like that but always makes the company sit up and take notice.

    If you have bailiffs calling then this has gone past the original questions you asked and it is serious

    I do not know whether Ralphy is a landlord or not but I have for over 40 years.  I can assure you it is not serious. 

    HCEOs can only take assets which they have reasonable cause to think might belong to the debtor.  Read my previous posts about dealing with identical situations.  
    You never know how far you can go until you go too far.

    i decided to all the debt collection agent Morston, in Birmingham.

    who did not say much. but said a long the lines of;
     ' that the writ is blinded to the property in your (  guess meaning the tenant ) hands from the date they received the writ, until it withdrawn and say to check Tribunals Courts and Enforcement act 2007, section 12 part 2, Paragraph 4.

    and they can seize sufficient amount from your ( assuming tenant) property. ( my property?)

    i was like WFT, but kept my cool, i mention that the property is not the tenants, he registered the car here because he lived there.
    i was told to dispute it.
    what, even if the tenant proves he live at another property.
    this is a crazy rule else people will just live in rented properties, build up fines and move....
    i am wondering if this is just a scare tactic...
    what do you all think...
