Can you add to that chronology, which address 'old' or 'new' each thing went to, please.

And WHO did you inform about the new address and in response to what?

i.e. why would you suddenly tell a PPC you moved, and you don't mean you informed the court, do you, because you didn't know about a claim?  Who did you tell and how (letter, email?) and why then?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Parking incident: 3rd September 2018
No correspondence received (that I recall)
Moved to new house : October 2019
Claim form allegedly sent to old house: Feb 2020 (mother didn't find anything)
Rung BW Legal on back of a penalty notice (delivered to old house) to inform of new address: March 2020 (i believe it was earlier in the year but this is what they told me today)
August 2020: Notice of pending CCJ to new address
August 2020: Judgement for Claimant received to new address
    19th September 2020 - deadline to pay £277.76
Neither myself nor my mother have held a physical claim form in our hands.
I acted without knowledge so I'm at fault for ringing them and giving the new address without reading up on it before.

Did they explain why they then sought judgment in default?

Yes, now I think about it and speak to my missus I remember saying I've not received a claim form when the agent mentioned it, at which point I gave my new address. I haven't yet received a claim form so thought nothing of it (I'm not going to chase it if they aren't) but saw the judgement earlier.

Wait, when you spoke to them in March they TOLD you they'd issued a claim... and you didn't ask for a copy or tell them to re-serve it to the right address, and you thought it wouldn't affect you?

Nothing wrong with informing them of your new address.

Check your phone records and confirm the date because that's pretty important.

    Good morning,
Well that was my intention with providing my new address to them, in the hope I would get the PCN/claim form, which I didn't.

  • But you didnt do the obvious and ask? Yes or No
  • But you didnt do the obvious and ask? Yes or No
Not going to pretend like I remember the exact conversation but I'm guessing I would've asked them to resend anything they did send. So, yes.
  • So obviously you state that :)
Do you have records of the date? Check phone history
