  • Easily - they apply to the court with a consent order, which you sign, asknig for judgement to be set aside and for the claims to be dismissed.

    An update.. Nothing back regarding the data breach. Assume they aren't buying it so I'll go ahead and report them shortly 

    My friend has had a reply regarding funding assistance and is required to provide proof of funds etc.. so going down that route at the moment

    After nearly 2 months my friend has got a letter out of the blue with  notice of hearing and all 3 cases amalgamated into one hearing. 

    Due to COVID the hearing is via tele conference. Not ideal. 

    There is nothing on the letter regarding a Aos? Am i missing something? 
    My friend is incredibly nervous and apprehensive I am happy to represent on her behalf as a lay rep? How do I facilitate this I can't find much info on the forum thank you,

    Witness statements / reclaim of costs / Defence to follow

    It is a set aside hearing as requested in draft order
    Re; telephone hearings I'm assuming you are finding that the PPC's are now attending more hearings? 

    Will take a look at the telephone hearings sticky, The lay rep (Myself) will not be in the same place and I would rather it just be me in the call i.e. no need for my friend to attend. I'll get in touch with the county court then?

    Not really.  CEL sometimes send in a load of guff but rarely attend a set aside hearing - but they might.

    The lay rep (Myself) will not be in the same place and I would rather it just be me in the call i.e. no need for my friend to attend.
    Oh come on, that can't happen.  Read any other threads with lay reps discussed.  Of course she has to attend.

    Did you read that document I pointed you towards?
    It's not very long, but here is just one salient point:
    3.(2) A lay representative may not exercise any right of audience:–
    (a) where his client does not attend the hearing;

    Sorry, Mis-interpreted the function of a Lay-Rep but its no big issue that my friend that attends.

    just to 100% confirm Now I have  the set aside hearing the only documents I need to provide to the court are;

    1. Draft order (the same one I submitted earlier) 

    2. witness statement as presented earlier 


    I am going to contact the court just to confirm 100% that this is a set aside hearing as the paperwork is ambiguous and they’ve also missed one of the claim numbers that was stated in the draft order.
