I want my dog back

  • I know we only paid £40 each for her but what annoys me most is that she's registered under my name at the vets and microchipped to me.  Considering I did most of the walking/feeding etc I think it's unfair the law will see her as "property" and not see me as her rightful owner.  I shed many a tear most days because I want her back and not been able to see her for 3 months now because he is being a totally spiteful narc.

Get an appointment with a lawyer. Most will give half an hour free.
Maybe  a lawyer's letter would work.

I tried the doglaw people, they weren't much help at all unfortunately.  I have contemplated just getting her from his (without breaking and entering) or from outside a shop when he leaves her there;  after all she is my dog and I was the one who always made sure she had good walks and up to date with inoculations.  He just isn't bothering with those and referred to her as "just a dog".  She got ignored most of the day after her walk, left to lay about or in her chair.  My poor little Roxy;  I am struggling to cope without her as I know full well she is as miserable as anything with him.
What did they say, specifically - that you would have difficulty in proving ownership to the court's satisfaction or some other reason?
Whether you consider it fair or not, dogs are property. So what did Doglaw say that makes you say they weren't much help?
All shall be well, and all shall be well, and all manner of things shall be well.

Pedant alert - it's could have, not could of.

Is she micro-chipped?   Is your name on the chip register?

I think I'd probably do just that as long as he doesn't know where you live now to do the same again and steal her from you.

  • Are you married ?

The OP has stated three times that the dog is microchipped and registered to her.

Yes she is registered to me and microchipped to me.  Was not married to ex, co-habiting.  We paid £40 each for her in cash.  Some say I can claim through small claims court others telling me I have to go higher than that because joint ownership.  I haven't been able to get any firm conclusion from anyone on where I need to apply to get custody of her back.  Prior to my living with my ex partner, Roxy lived with me and the cats for years!  Now he has her and I want her back where she will be happy again.

You're joint owners. Realistically you wont be getting her back.

Sorry, but the courts simpy wont order this after such a long time. You can maybe get your £40, but really is that worth going to court over
