Premier Park Dept Recovery Plus, Threat of Court Proceedings & Credit Checks - UPDATE OCTOBER 2020

Hi,
I've received a letters from 'Dept Collectors Plus' for Chippenham Hathaway Retail Park. I'm feeling lost, scared, deflated and uncertain about how next to proceed. I'm scared that the dept collectors will affect my record and I am going through the process of buying a home so I'm panicking right now.

Date of parking: 07/04/2020
Time elapsed: 12 minutes (ish) they are claiming 20
Letter from Premier Park: Dated 07/05/2020
Letter from Premier Park actually Received: 19/05/2020
Reminder Letter from Premier Park Dated: 05/06/2020
Letter from Dept Collectors Plus Dated: 01/07/2020 - received 06/07/2020
I sent Letter 6th July 2020 requesting POPLA

I have written & emailed Premier Park, but have not heard back from them & they have ignored my appeal from 19th May & 9th June 2020 and my subsequent letter of 6th July informing Dept Recovery Plus & Premier Park to provide a POPLA code within 35 days (which they did not).

I know I'm so stupid for overstaying but this was at a time when I was shopping for isolated & vulnerable family members & friends & we were all queuing for toilet roll and all of that food we didn't need! It was a world of never ending queues and waiting 45 minutes to get into a store! I was also very unwell myself (luckily not COVID) which is why there's a delay in response.

I've read that Kames are the land owners but I really don't know what to write to them. I've also read that local MPs can help, but not a clue what to say apart from help.
I now have the attached letter from Dept Recovery Plus & various checks by them on my credit search which is bringing my rating down!

Can anyone please assist, I'm scared & don't know what to do?

    This is very small beer indeed, a piddling parking ticket from a company without morals.

    PE's signs leave much to be desired and for this reason some judges have dismissed their claims, read this,

    Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs, and in some cases, cancellation. 

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,

    Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    I can understand why you are in panic mode ????  That letter says nothing of the sort about credit ratings

    It's just the nonsensical DRP adding fake amounts and as they are only vermin, you ignore them and never ever contact them.

    Unless of course they have ACTUALLY damaged your credit file ... have you checked on your credit file ?

    The title of this thread says ParkingEye, yet your post refers to Premier Park.

    These are two entirely different companies so please edit the title to correct this. The edit button is the cog-like icon near the top right of your post. If you are unable to edit because you are a new user, then please ask a board guide to edit the title for you.

    Your best option is to complain to the landowner direct and get it cancelled , explaining that the driver had to queue due to the lockdown rules so grace periods should have been extended

    Ignore the debt collector letters , they are powerless , it's PP that may issue a court claim , not any debt collectors

    Complain to the BPA about the lack of a popla code , depending on which Premier Park it is , there are a few , so full name and their address or location please , is it Premier Park ltd of Exeter ???

    Email a complaint to the BPA about not getting a POPLA code after an appeal.

    You are not stupid for overstaying.

    It is the PPC who are in the wrong, and you really need to understand the scam industry.  Please read the NEWBIES thread including the 4th post all about DRP letters, and more importantly, do not pay.

  • I want to thank people for replying. Although I was in an absolute state, I mentioned ParkingEye not the correct Premier Park by mistake, so apologies for that!
    I wrote to PremierPark in mid September and wrote to the local MP and requested a POPLA code, well this is what I received from Premier Park (see attached).
    I must admit that I did not hold on to any receipts from April 2020! Plus I know a few of the transactions were in cash as they were for vulnerable family members and friends.
    I requested the POPLA code and told them as they did not provide one within the 35 days, I have considered the matter closed.
    Debt Recovery also have the date incorrect on all of their letters stating a week difference!
    I also included the following which is why I guess they responded in this way:

    The debt is denied for the following reasons:

    1)     Keeper Liability not established – The Notice to Keeper is not compliant with the strict requirements of POFA 2012.

    2)     No evidence of Landowner Authority - the operator is put to strict proof of full compliance with the BPA Code of Practice.

    3)     Unclear/inadequate and/or misleading signage - There is no mention of any terms and conditions on the car park entrance sign and no signs are visible to drivers approaching the car park. Also within this car park the signs are not prominent, clear or legible from inside the vehicle and can not been seen, let alone read, without having to turn your head (which breaches the BPA code of practice Appendix 

    4)     There was no valid contract formed between Premier Park and the driver

    Any advice on how to respond would be greatly appreciated as I'm still not in possession of a POPLA code!

    Do not respond to debt collectors , disregard them and file the paperwork , read the fourth post in the newbies FAQ sticky thread near the top of the forum , because it doesn't look like you have read it, do not contact the debt collectors at all !

    Debt collectors are powerless

    Only Premier Park or their legal representative (solicitors) can issue a court claim

    Complain about the lack of a Popla code to the BPA AOS team , on the BPA website

    Email your MP and ask them to intervene , give them a copy of your post above , plus any extra details , photos and documents , keep all the originals

    Try to find more details fro the landowner and complain to them , ASAP , if you get the landowner to intervene then it should end your nightmare , otherwise only a judge can decide the outcome

    Name the location and postcode on here if that car park

    Did I mention ignoring the debt collectors ?? Ignore , ignore , ignore

  • Hi All,
    I have contacted the MP with no response at all. I contested the parking charge with NO POPLA at all.
    I have contested that the signs are useless (not the wording I used).
    Can I submit a POPLA myself?
    I have received this now from Zenith Dept Collectors.
    What do I do? I can't find the landowners anywhere to be able to contact them.
    I don't think there is sufficient signage - especially as there is literally no signage prior to entering the car park, only after you enter.
    Please help, what do I do now?
