Car accident but not got other driver's details
Hi,
Since the accident on Thursday, it has been annoying me ever since. Due to my stupidity, I never got the other driver's details but gave him mine, and I've not heard anything from my insurance company.
The accident involved me hitting the other driver's left side as it turned right in to a BP forecourt. At the time, he came out of his car accusing me of speeding (doing 50mph on 30mph), and all I could think at the time was whether I was speeding (I never speed intentionally) or not, clouding my judgement. I gave him my details but never took his. After thinking about it, I don't think it is my fault as it was my right of way and driving that road this morning, I do not feel I was going any quicker than I was this morning.

I damaged my front passenger side with broken headlight assembly (I've replaced), bumper and slight bent in wheel arch.

So it is annoying me that I may have been taken for a mug (rather apt username).
Is is possible to get the driver's reg number from the petrol stations CCTV, with data protection and all that? Or if I even have a non fault claim at all?
Any advice is welcome and thanks in advance.

It's all rather confusing, if they are turning right and you have hit their nearside, then
1) He ignored you approaching
2) You ignored them making the manouvre
If they saw you speeding why did they continue to make the manouvre?
It sort of looks like split liability.
However if they are on your side of the carraigeway then that tilts to the 3rd party.
But if you hit their rear , they were already across the carraigeway, so that tilts against you.
The CCTV footage is not available to you.

Whatever happens, you'll have to tell your insurer. Better to do it before the 3rd party does.2

Just tell your insurer, and explain you haven't got his details, and when he makes a claim against you they can sort out who he is.He undoubtedly will claim against you as he is convinced it is your fault.I want to go back to The Olden Days, when every single thing that I can think of was better.....

In a 30 limit? You clearly had a lot of time to see them and avoid the collision...mug51 said:

It's difficult to know as we were not there, my earlier reply was based on probability, if they are across the carraigeway and you have hit them in the side rear, then yes it does appear to be you at fault, if the collision was his offside and yours then it maybe their fault, however the cost to conclude may render a split liability.mug51 said:Thanks for the replies guys, the consensus appears to be my fault.

There's a 90 degree bend 8 houses back and a bend just ahead. Unless you were driving stupidly its highly unlikely you were doing 50. Regardless of your speed (within reason) they shouldn't have driven across your path. If they had looked they should have seen you. Claims that you were speeding is their only defence, the alternative is they crossed in front of you when they shouldn't have, their mistake..Ask at the garage, they might help.0

No. They drove across your lane. If they were driving at speed most of the van would have crossed the lane before you got to it which is why you hit the rear and not the front.mug51 said:
