As above.  If they're a firmer employer sue them.
  • Thank you all for the replies, I do appreciate the help & suggestions!

I am considering an appeal, but have now sought out legal advice so I can see if I can find any specific legal errors or oversights the Judge made when ruling. I did contact Head Office of the ex-employer who said they’d be happy to write a letter saying they sent my details to CEL  - however, I’ve been told the Judge could refuse to accept this new evidence, on the grounds it should have been submitted the first time.

With regards to suing the ex-employer, I feel that probably has more likelihood of succeeding than appealing to/dealing with the same Judge  all over again (even though that’s what I’d prefer). However, after the loss of this case which I and other legal professionals were 99% sure I’d win due to my evidence  - I’m fully aware HB could some how get away with it, just like CEL did, leaving me with yet another bill to foot.

I did visit HB on Monday to inform them if this, and they have completely new management. The current store manager did sympathise, but said from her experience there is no way to win, as she herself was ordered to pay over £3,000 in PCN’s for parking there, despite submitting her registration and making numerous appeals. Unfortunately she now has had bailiffs at her door.

They have since changed the company who manage the car park from CEL to UKPC, as this apparently kept happening to all the workers who parked there.

It’s incredibly strange to me that they have been getting away with charging people like this, especially with the help of the legal system too.

I will see what the solicitor I have contacted will advise, and let you guys know from there. If the chances of winning are slim to none, or it’s too complicated or expensive to pursue, I may well just have to take this an expensive ‘lesson’.

Future workplaces will have to have parking options that do not depend on the passing on of my registration details by the employer, as this whole thing has been a nightmare!
  • Good luck with whatever you decide, I'd be interested to know the outcome.
Definitely take them up on their offer to put something in writing and hang on to it.

Why the hell do people like that put up with it, she works there and this was absolutely NOT OK and not something HB could absolve themselves from (and she could have won all of them at POPLA, had she come here after Googling it).

Why do the British public allow this industry to operate and get away with this, is it because people think they have a real fine?  Let's hope the new PAS232 is as robust as it should be once the statutory code of practice is finalised by the MHCLG.

They need to get this right.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
