That would be a fairly strong point to make to the court, when pointing out -what eldse are you supposed to do at a barrier? Drive right on through it? How long to stop to read the signage at the barrier are you allowed? If you're not allowed to read the signage there, why do they place it there? and so on.
Obv only talk abotu whats true but you can make it out to be ridiculous.4 -
ginger_bread_man won his case. I suggest you have a look at his comments about the court hearing, especially the judge's findings, and use those words when you robustly reply to the LBC.
Complain again to the Airport owners. Spell out that the car in your case was in the same place as the one in g_m_m's case, which is outside the area that VCS have been contracted to operate. Quote their case number if it was given.
Add in that Airport Byelaws apply, therefore as vehicle keeper you cannot be held liable.
Ask them for the contact details of the person who will be attending court, pointing out that as principle they are liable for the actions of their contractor and you have the right to cross examine them.
You could look into a counter claim if you are up to it. You should certainly mention that you may make a counter claim if this is not cancelled.
There was another thread about a motorist who won their case at a different part of the same airport because again the car was outside the red line that VCS are authorised to scam, possibly the one who posted on your thread last year.I married my cousin. I had to...I don't have a sister.

I've been keeping up to date with the very similar cases that VCS have brought and lost against similar incidents at Bristol Airport. I have written to the airport twice already but hit a brick wall. I was aware of any Airport correspondence finding it's way to VCS so didn't want to be to open handed. I didn't think VCS would be beyond changing the map retrospectively too include the slip road up to the barrier. This whole episode is making me slightly paranoid. ...and pointing out that, as they are the principal to the contract, harassment by their agent is their responsibilty, as is the breach of the DPA2018 in obtaining your details, and...
As such you woudl seek to include them in a Part 20 application as a co-defendant to your Counterclaim, should their agent VCS carry through its threat of filing a claim that is doomed to failure.
Or they could act as a responsible principal and instruct their agent to cancel the ticket and apologise, and let you know what sanctions tehy will place on VCS for ticketing outside of the area contracted. You await their reply as it will inform you of the direction your complaint to the ICO about Bristol Airport (full company name) will take take7 -
