    RK is who the DVLA is told is the Keeper
    The Keeper may be the RK, but is defined as the person who is in day to day charge of the vehicle.
    For example the rK could be a leasing firm. 
  • Ah, I see.  So I am the keeper but I'm NOT the RK.  The VCS paperwork is coming to me not the RK, so I have to proceed on that basis.  I will also have a third stab at contacting Bristol Airport to ask them to intervene as I note this is an option in their contract with VCS.  Do landowners and VCS share data in these cases? Could my letter to Bristol Airport form part of the court documents from VCS if it goes to court?
  • Yes, and thats fine. Its not a difficult or unusual position. 
    Are you hiring / leasing the vehicle? 
    They cannot share data
    BUt take obvious steps, such as NOT ever revealin the driver.

    Agreed, clearly you must assume VCS will see your complaint so you write as the lessee/hirer (or keeper) and talk about the car only briefly stopping, not who the driver was who stopped it.

  • I have complained to Bristol Airport CEO dlees@bristolairport.co.uk and Hilton Hotels after my appeal was rejected by VCS. It is impossible to reach the hotel reception without stopping at the car park barriers which only open if you get out and press a button according to VCS. The signage is confusing and we had no idea that the car park was owned by Bristol Airport.
  • Today I received a Letter Before Claim direct from VCS for the stopping charge at Bristol Airport.  The SAR request was done today. I'm following the advice in the newbies sticky not to complete the enclosed reply forms.  As the letter came direct from VCS and not via their legal firm I'm assuming I do not need to write to them about seeking debt advice and denying the debt.  Can someone confirm I've got this correct?  Thank you.

    Hmmmm...I seem to recall yesterday, someone posted that they'd got a Hotel to lean on VCS to cancel one just like this, exact same scenario, stopped at the barriers.  Pretty sure it was Bristol Airport too and the poster may have posted who they contacted.  I think it was yesterday, might have been the day before so it will be in the first dozen pages of the forum and obviously the thread titles give you a clue.

    I recall the case was already at claim stage so the Hotel must be very p'eed off, to have forced VCS to discontinue.

  • The post you referenced about the Hilton Hotel was posted on this thread but isn't related to my claim.  I stopped at the barrier to the short stay car park not to the hotel car park.  I've written to Bristol Airport twice but they will not take action.  With regard to my original question, do I need to write to VCS denying the debt if the lbc came direct from them rather than via a legal firm? Thank you

     Yes you do. Telling them something like:

    "Although I deny any debt is owed, I am seeking debt advice and as detailed in paragraph 4.2 of the Pre-Action Protocol for Debt Claims I require you to delay further activity on this Claim for thirty days".
  • Thanks Keith, I'll get that done and begin researching so I have my ducks in a row for the next stage if this turns into a court claim.
