    Only way to find out is to contact the utility company.  Of course it's 'possible' to have the pole removed, but the fact that the pole also has wires to other properties will likely complicate matters.  Will the neighbours want their gardens dug up, for example, and will they be willing to pay anything if they don't care about the overhead wires?  Likely to be an expensive job.

    Utilities have the right to place equipment wherever they like to provide a service , even on your land and without your agreement.

    As above , this is likely to be very expensive and at your cost . It could possibly be moved into ducting but would require also doing all your neighbours , again at your cost as I suspect none of them would volunteer to pay for something that only you want

    What's the chance that this previously not in the garden, but on a piece of land that has be 'claimed' by a previous owner?
    30th June 2021 completely debt free…. Downsized, reduced working hours and living the dream.

     I want to remove it as it effectively makes 1/3 of the garden unusable.  The utility company confirm that there is no wayleaves Or lease for the pole. Can it be brought underground or off the property - as if there is no wayleaves surely that means it’s ‘trespassing’? 
    It's not trespassing, but you should be able to claim the wayleave. Basically, the power company can come onto your property at any time in order to attend to any problems with the supply.
     We have 3 of them+ a BT pole. The electricity company are much nicer to deal with. Last time was in the spring when I found a  young lady wandering from pole to pole assessing when our oak trees would next need a trim. They used to use a helicopter , but she said she was cheaper and a lot less scary!
    Our line, the line to the barn and the neighbour's line all go underground at the last pole, so we have nothing in the garden, but older buildings across the road have theirs overhead. I understand it costs a considerable amount to get them buried; certainly more than the uplift in value you'd achieve by losing the pole.
    I don't think the garden area's unusable,. It just needs a bit of creativity to design-in the stays.

    Hello, can anyone recommend a template I can use to write to utility company to remove pole from my garden ? I checked deeds and there is no wayleaves or easement for the pole.

    Assuming your the property owner, didn't you notice this Poll before you purchased the property and how long have you been the owner for ?

    How would we work out the odds? We inherited a BT pole that was relocated (probably via a financial incentive) when Openreach employees dealt with lightning strike damage. Neighbour knew the owner of our property was detained at Her Majesty's pleasure, so took the opportunity, then erected outbuildings on the site where the pole had been.
    What's the chance of that? :D
  • We have an electric pole and stay wire in our front garden, the previous wayleave had lapsed. The stay makes parking difficult so we asked them to move it.

    An engineer came out and agreed that they could move the stay about 1m. They are going to charge £700 for that and we'll get back £350 for the wayleave.

    I wasn't aware that wayleaves lapse. My payment comes through regularly every year, and so far as I know, it will continue to do so, because it's compensation for the inconvenience, and that will also continue for the foreseeable future.
    It also wouldn't be very convenient for the power distribution company if their legal dept had to keep renewing  wayleaves on top of creating new ones and paying out on the old.
    But I'm open to being enlightened.....

    We saw a copy of the old wayleave, signed by the previous owner of the house, it was for 15 years.
    The contract we are going to sign is also for 15 years. This is for a one off payment, maybe that's why it gets renewed?
    This is SSE, maybe other companies do it differently.

    Ah, yes, that'll explain it - we get an annual ongoing payment from Western Power, no expiry.
