Apologies - the claimant via Gladstone’s letter / email to myself.KeithP said:
And who is 'they'? The court or the claimant?PCN_BoBeB said:Defence filed.
shock horror, they’ve offered mediation. We act for the Claimant and have notified the Court of the Claimant’s intention to proceed with the Claim. You will note the Claimant has elected to mediate in an attempt to settle this matter amicably, without the need for further Court intervention. Should you agree to mediation, please inform the Court who will contact both parties to arrange a mediation appointment.0 -
Standard stuff. Await the court notification, then decline mediation. Isn't it included in the NEWBIES FAQ sticky, second post, in the section marked up in red: IMPORTANT - KNOW WHAT YOU MUST DO AND BY WHEN!
I thought you might have been expecting this, for sure, the more you are prepared for this stuff in advance, the less chance there is of a 'shock horror' reaction. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The shock horror was more sarcasm than real shock.Umkomaas said:Standard stuff. Await the court notification, then decline mediation. Isn't it included in the NEWBIES FAQ sticky, second post, in the section marked up in red: IMPORTANT - KNOW WHAT YOU MUST DO AND BY WHEN!

I have now received notice of allocation in the small claims track (hearing) and am putting together my WS.
Am I right in understanding that I should also receive the claimants WS at some point before the deadline?0 -
Both parties (the Claimant and Defendant) have exactly the same deadline for filing (with the court) and serving (on the other party) their Witness Statement and other documents they intend to rely on.PCN_BoBeB said:Am I right in understanding that I should also receive the claimants WS at some point before the deadline?
Doesn't your Notice of Allocation say something like that?3 -
It varies. Ours was 7 days after the claimant's, but often it's the same. @PCN_BoBeB , get yours ready. If you see the Claimant's WS before your deadline, that's a bonus. Concentrate on your steps - HX are hoping you stumble.

Ive got my first draft of my ws, is Dropbox the only accepted means of having the WS reviewed?0

You could copy and paste it here, minus your name. Might fill two replies but that's the best way to get people to look.
The latest example is posted by @jrhys, shows what to include, plus click on my username and see my 'Discussions' and find the one with the 2 transcripts. You need both.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
