hahahahahahahahahahahahahahahahahahahah - i would wear out the h and the a if i continued this.....karenjdot said:Thanks all, breakdown listed as follows:-
I will be seeking a rent repayment order for the full 12 months, which totals £13,800.
I will be seeking £10,000 compensation for the breach of covenant of quiet enjoyment.
I will be seeking £10,000 compensation for the common assault
I will be seeking £2,000 for respray costs to car
I will be seeking £10,000 compensation for breaching the data protection act.
In total, I am seeking £45,800. I am willing to enter into negotiation regarding a settlement figure before initiating court proceedings. Given the strength of evidence I would advise you to consider this seriously.
Honestly no.
just FYI:
DPA breach is about £750, so take from that what you will regarding the calibre of his claims...3 -
I suspect this idiot of a tenant has been told by someone in the pub it costs £25 to file a Small Claims Court action. He is in for a shock if he think that level of fee applies here.
As said before, call his bluff.2 -
Where do the common assault and respray costs come into it?
Want to share a little more of the back story? All shall be well, and all shall be well, and all manner of things shall be well.
Pedant alert - it's could have not could of.6 -
Thank you, had sleepless night but good to get some feedback!0

£46k isn't a small claim. As has been said, it will cost him a LOT of money to lodge a claim for that amount, and it's proper big-boy's-court. Which he will be laughed out of.
Right now, he's just threatening. No more than that.
Now imagine what a PITA he's going to be when the s21 actually expires...
I have to admit, though, I'm baffled by several of the heads-of-claim...
Respray the car? Why?
Data protection? Wha?
And what "common assault"? Did he contact the police to have this assault recorded and charges pressed?1 -
He sounds deranged.
If there is nothing in the other claims, just call his bluff. It seems to me to be an attempt to intimidate and wish for a settlement, however small. Maybe he's had success with it in the past.

karenjdot said:Hi,
I have a couple renting our house, despite him repeatedly paying his rent either late or not at all, we served a section 21notice purely to take the least line of resistance and get our house back. .....The notice for rent late or underpaid is a section 8 notice. Yes an s8g10 may be validly served if only 1p is underpaid for only 1 day.So, serve s8 TODAY! (g11 at least) and I'll get the popcorn in for the harassment case. If any outstanding rent perhaps MCoL claim also ...1 -
Thanks numbercruncher8 that is what I am beginning to think is what’s happening here, he is chancing his luck. He called the police when he changed the locks and they promptly arrived saw that there was no disturbance (whilst elderly neighbours were looking on) and told him to change them back as this is an offence and asked if we wanted to press charges, which we said no. He cowered behind the door whilst changing the locks. There is a lot more I can say but suffice to say he told us he would not be paying rent during lock down as he had no money and we initially took pity on him until we found out that he had been sacked from his pub chef job due to repeatedly being told not to smoke marijuana whilst in the kitchen, since we discovered this the relationship broke down irreplaceably and we just want shot of him.0

He sounds like an absolute waster then. Out of interest, his initials arent RS are they? I know a waster who dabbles in working in pub kitchens.0
