Harassment

Hi,

I have a couple renting our house, despite him repeatedly paying his rent either late or not at all, we served a section 21notice purely to take the least line of resistance and get our house back. Within 1 month of serving the notice, he now is trying to sue for damages due to harassment. He (not a solicitor) states he has proof of harassment as he recorded any house inspections (2 in one year of renting) and I visit to repair a stiff back door and blocked drain, he was pouring cooking fat down the sink. He is stating 1st tier small claims court with a view to claim £45,800 but will negotiate.

Would very much appreciate anyone advice regarding Harassment claims from tenants?

I mean, he doesn't have a case at all, but I'm intrigued by how he arrived at the figure of £45,800?

if you can't see the ridiculousness of that claim pay a solicitor to "advise" you so he can laugh in your face to show you what it "means" to those experienced in housing law

Surely the OP means £458. It would cost him over £2k to merely even lodge a claim for £45,800.

and someone complained earlier that the landlords have it all cushty and it is tenants who are getting bad deals in the uk.
this is why the vetting process for tenants are so stringent in the UK.
OP - ignore the idiot.  he hasn't got a leg to stand on.

This is of course not at all what I said.

A cross thread bite, impressive work AskAsk.
  • Thanks all, breakdown listed as follows:-

I will be seeking a rent repayment order for the full 12 months, which totals £13,800.

I will be seeking £10,000 compensation for the breach of covenant of quiet enjoyment.

I will be seeking £10,000 compensation for the common assault

I will be seeking £2,000 for respray costs to car

I will be seeking £10,000 compensation for breaching the data protection act.

In total, I am seeking £45,800. I am willing to enter into negotiation regarding a settlement figure before initiating court proceedings. Given the strength of evidence I would advise you to consider this seriously.

Tell him to file his claim and waste £2k (£2,061 to be precise), call his bluff. Beyond ridiculous.
