Argos lost my ‘Click & Collect’ parcel. They will not pay compensation.

Has anyone had a similar experience as me with Argos ‘loosing’ a ‘click and collect parcel’ which was delivered to their store just prior to them shutting all their stand alone stores in March. The parcel contained an Apple iPhone 7 from a seller on eBay value £132.99 (incl. p&p)

The parcel was delivered by Royal Mail and I have had from them the time and date of the delivery which includes a signature of an Argos employee. Argos say they sent it back to the sender by an ‘eBay system’. I have asked Argos to advise me the date when the parcel was returned to the sender and by what method of return along with any paperwork they have.  They answered that they do not know and they do not have any paperwork. The seller has informed that he has not received the iPhone.

I suggested that they should compensate me to the value of the iPhone but they have refused.

I feel that they are just fobbing me off. Any suggestions of what my next step should be?

    Argos will not be compensating you.

    Your seller is the only one who has a contract with Argos so they need to be claiming through whatever insurance is in place for the Argos click and collect service. Argos need to compensate the seller. The seller should be refunding you.

    Did the seller arrange the click and collect service as part of the delivery? (This is the critical fact - whoever arranged and paid for it is who is responsible for chasing Argos. It is reasonable to assume that this is the seller, but cannot be taken as fact).

    I paid the seller back in March, he said he would refund me if he gets the iPhone back. We have had some correspondence when he sent me the details he received from Royal Mail but I have not heard from him since then. I can only contact him via a message through eBay, I do not have an email address  for him. I do not think he is bothered.

    I requested, to the seller, that the iPhone should be delivered to my local Argos Store via the click & collect service. I paid post and packaging to the seller. I have done all the chasing of Argos.

    I believe ebay has a system for dealing with items not received.

    Yes Ebay do have a system for items not received and I logged a claim with them.  But this was turned down as the item was delivered to the correct address, the address I had requested, e.g. the Argos Store. The seller sent details from Royal Mail to Ebay to prove this.

    The item was received, to the address the buyer requested, and the seller can prove this. The buyer admits it got there too.

    The buyer needs to chase Argos some more (good luck!) and maybe explore what this "ebay system" was Argos used to send the item back -- presumably they didn't want to be in the position of having your item while about to close the store down for the forseeable future.

    Argos did not answer any questions I put to them. Three different ladies were replying to my emails with the same ‘sorry you are not happy’ ‘sorry you are dissatisfied’ with our response, even suggested that I seek  third party advice. Not much hope in getting a meaningful reply there. I think I should write to the CEO who I think is a Mr Simon Roberts.

    I don't use this service any more after my parcel was signed for by an Argos Employee who also stole my parcel, i was told that the employee no longer works for them and their is nothing they can do, the Ebay seller was also told She won't get any compensation as Royalmail had successfully delivered the item.
    Argos refused to give me anything and after weeks of dead ends with Argos,Ebay denying reponsibility Paypal reinbursed me for the cost. I personally would complain to all the involved parties, using social media to vent my anger in public was the most effective tool i noticed, they hate the public seeing these problems.
