Has anyone had any joy chasing Wonga by phone? They just give me a standard 'sorry for the delay' email when I chase them via email.

Would I be wasting my time?

Not sure to be honest. I sent my email a week ago and haven't even had an acknowledgement yet. I'll try calling, might as well give it a try.

sorry to jump on this thread but I have been reading back through the thread and I am not sure where I stand

I took out some PDL one I am still paying back via debt agency and one I paid back fully, how do I know if I am entitled to challenge them?

you're entitled to challenge all, as long as you can prove irresponsible lending. ie had one loan paid back large amount took another loan out.
or your credit files show you had a lot of debt issues like missed payments etc during the time you prior to them giving you the loan, your argument is based around how responsible they were in giving you the loans and rolling them over.

    Quick update :

Myjar - investigated and refunded £580 within 4 weeks of complaint.
QQ - 4 weeks in, filled in questionnaire, waiting for reply
Wonga - email to say they haven't yet concluded investigation but they hope to deal within 8 weeks
Payday express - acknowledged and asked to wait 8 weeks
    PDUK - acknowledged and asked to wait 8 weeks but here's the strange bit;

Tonight PDUK wrote a letter attached by email explaining that 'due to human error' they have accidentally breaches data protection by providing my name, DOB, address and phone numbers to a third party. They say sorry and offered £50 in compensation.

So what do people think I should so regarding this one ? I'm peed off that they have done this clearly but anyone else come cross this ??

Cheers :-) and thanks for all the help so far

Stuart, did you have any loans with other providers at the time you had myjar, they stated they performed their affordability checks when you last applied, but they did not mention these checks were performed before on the other loans.

Your last advance from us was requested on 28 August 2015, scheduled to be repaid in three instalments. You repaid your loan early and it was closed on 5 November 2015. You contacted us again on 21 December 2015 to request a new loan. On that occasion, we were unable to lend you as the credit bureau (CallCredit) believed that you had several credit commitments at the time.

this also ring alarm bells to me as well can you prove you had these commitments when they offered you the loans previously...

you're loan ended on the 5th November 2015, one month later you tried again and was declined... my argument here would be you were trying to get out of the debt spiral you were caused by these PDL'S.

No other loans..only the 73 with Wonga previously to My Jar.

As they have not sent the requested statement of loans ive used credit file and they show loans taken from December 2014 and two in January and then every month until Aug 2015 with two in March.

My situation/commitments was stable over the course of taking loans...nothing changed from 1st loan until being declined on the last two occasions of requesting,if anything credit file would have improved through paying bills on time etc.

I'm assuming next step is FOS.?

    Update regarding Lending Stream.

I had three loans with them. My first one took 11 months to pay off as I went on a repayment plan straight away.

My second loan was approved three months after the first one was finally paid off. Now here's the interesting bit - My third loan was approved less than a month after taking the second one out even though I hadn't paid it off. So they had lent to me despite already having an active loan. Surely the circumstances of the first one should have raised a few questions.

Anyway, they have replied saying they believe they had acted responsibly and have not made any kind of offer, nor have they said it's their final response. I have fired another email off asking them to reconsider and have said I will be taking it to the FOS if they don't change their mind.
  • Haven't posted in a while. 3 complaints still with the FOS.
Received a letter yesterday from ombudsman ruling in my favour against Wonga :) all interest and charges plus 8% to be repaid. I've replied saying that I accept their decision. Does anyone know how long before they pay out?
QQ - adjudicator agreed with me. Just waiting for them to reply. Interest, charges and 8% :)
Payday UK - adjudicator waiting for info from them.

Just came back from a lovely family break in North Yorkshire to a letter from the Ombudsman-agreeing with everything the adjudicator had stated after his investigations-these being that QQ did not carry out proper checks after the 2nd loan and that I was becoming reliant on payday loans, rolling over on several occasions as well as having a flex account.
The Ombudsman stated that all interest from the 2nd loan onwards and all interest on the flex account should be paid back to me as well as statutory 8% added to the amount and all loans removed from my credit file.I have a month to accept these findings now-who am I kidding, lol I'll be contacting them first thing Monday morning to say I accept :).Then just a waiting game on pay-out from QQ.

  • Just an update so people are aware if time frame. Complained to QQ & p2p end of Jan. adj' upheld my complaint mid may. End of may passed on to an ombudsmen as QQ/p2p didnt agree, still waiting to hear from the ombudsmen (6 weeks)

Not at all amused with the FOS. The adjudicator who had my Sunny case (I already locked horns with her over MyJar) has basically said Sunny did not behave unreasonably clearing my bank account out on Xmas Eve after I told them I was very mentally unwell and provided a letter from a consultant psychiatrist confirming this. They had also agreed to a payment plan and went ahead and took the full payment. She actually said she 'understood my frustrations' (clearly not) but doesn't believe Sunny had acted unfairly!
I sent back a very annoyed email saying I was staggered at her view point and I want an Ombudsman to look at it as I feel like she has not been subjective and doesn't fully appreciate the brevity of the complaint. She hasn't replied to my last email but does anyone know if a) I can put in a complaint about her and b) if she refuses to escalate my case to an Ombudsman (which I'm about 99.5% certain she will do) how I can go over her head?

  • They can't refuse to esculate Mrs Ryan. After the adj' makes a decsion the pdl company or yourself can disagree with them and ask an ombudsmen to look at the complaint
