  • If someone calls YOU, why arent you verifying THEM?! Seriously...
Yes Rookie error on my part upon reflection 🤦‍♂️
  • Stop engaging with them.  You are not required to make offers and your case has not changed.  They may well discontinue so sit on your hands as regards replying to them and tell them to get lost if they phone you again.

Horrible company to deal with, truly a pariah on the public, these robo-claim legal firms.  A waste of a law degree.

Concentrate on getting your WS & evidence together and show us.
Thanks - I'll not engage with the email and block them from having any further calls. Once I've completed my WS I'll upload it on here for feedback 👍
  • Hi All,
Please find attached my WS - any feedback welcomed. I received the claimants one today via email.
I have until Friday 4pm to send it via email and Thursday 1pm to post it.

    Thanks

It seems I'm unable to upload it - the file format is  'unsupported'. Any ideas? It's a MS word doc 🤷‍♂️

Host it on Dropbox or imgur.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The question I always ask when I see the documents someone submits to the court, running into a massive word count, as far as an extremely busy Judge having to read thousands upon thousands of words, would this be more or less beneficial to my case?

    Think about it.

    The claimant?:-

    Bank Park Management Limited

So it would be wise to refer to the relevant AoS   -   they are IPC members yet reference to the BPA CoP is stated many times.

In paras 23 and 24 you mention CRA 2015. There is no previous mention of that Act.
It is introduced properly much later - in para 35.

Para 43 starts: 43. The Defendant appends with this bundle, a fully detailed costs assessment which also covers proportionate costs.
    I wouldn't call Exhibit XX-19 fully detailed.
I suggest that even a Costs Schedule for ordinary costs should be far more detailed than yours.
Don't forget to take a payslip, or something similar, to the hearing to prove your loss of earnings.

What Keith means is, the first time you mention an Act, put it in full but with ('CRA 2015') in brackets immediately after, to signify that later mentions will call the Act that.  Your version has that back to front.
