Merry hill shopping centre INTU parking fine escalated to county court business centre

Hi guys, just a quick one . I parked at the merry hill shopping centre in the West Midlands last June and received a parking fine . I spoke to my solicitor friend who said she rips them up and to ignore them . Which I did ! As they are not enforceable . However it would seem she is wrong or just lucky as she has ripped up about 6 and had no come back from it . I received a red warning letter which threatened me with bailiffs (even before a county court claim) very aggressive in nature . Which I again ignored . Obviously in my error because today I received a claim form from county court business centre in Northampton. I have called them to check it’s real . Seems abit suspect as looks like it’s on photocopied paper but I am in the process of buying a house and can not afford to get a ccj at this time. I have read all the threads including the newbies thread on this and need some help on my defence . Can someone point me in the right direction as to what to put . I had parked in a corner of the car park with no yellow lines on the road however it wasn’t a white line bay. There was no signs stating you couldn’t park there . And a year later there are still no road markings to deter parking there . Seems like a bit of a trap to be honest . AnyOne that can help with putting my defence forward on the form ?

thank in advance

Your firendhas given you poor advice.

It is not a fine, it is an invoice from an ex-clamper to compensate them for the alleged harm they suffered when you did what you did. We call it a scam. Pay them not a penny unless a judge so orders it.

Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs, and in some cases, cancellation.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,

Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

It's free parking with no time limit so are they saying that you did not park in a designated space? You need to get some images of the signs.

     FYI INTU are in administration.

  • First step you need to tell us the issue date
Then you need to foloow the instructions, that answer every possible question, in teh NEWBIES THREAD to acknowledge service online
You must do so, and confirm so.
It was June 2019 when the original ticket was issued.

Just the job for you solicitor friend. There again, given her advice so far, are you looking to win?

INTU won't have issued proceedings, surely?  Who exactly is the claimant and who are the solicitors?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

It wasn’t intu but a private firm called bank park management who have passed it to dcb legal .
