    Push the BPA hard on this. Email Steve Clark to get a sensible and considered reply.

    Umkomaas thank you for the advice, do you have any suggestions on what I should say to him? Do people often email him direct?

    People here always email him direct...I am sure he gets a bit fed up but when crap like that is coming from the BPA then they deserve an escalated complaint.  They can't LIE about the law!  

    You were already told what to say.  Quote the Act.  We are not going to write an email for a poster!

    You tell Steve that, despite the BPA fully well knowing the law on this, theyt are misleading a consumer by stating that a Keeper cannot transfer liability before proceedings are issued. You ask how they will be retraining the responders

    Hi. MY wife received  a PCN from our local Council. 
    She had parked her car in a disabled bay, she has a disabled badge but was just dropping off a bag of clothing into the adjacent charity shop. As she was only dropping off the bag she did put her badge on display, she was only in the shop for 2 minutes, consequently she received a PCN for parking in a disable bay whilst not displaying a blue badge.
    The Council warden has entered the wrong vehicle registration number for her car (A wrong letter) on the PCN printed paper. Can we ignore the PCN

    Given it is a council PCN, and nothing to do with Parking Eye, why have you 
    a) posted on a thread for parking eye
    b) posted on a thread nothign to do with you, which is obviously rude?
    Council PCNs cannot be ignored. If you do, you will have bailiffs at the door, and you will not be in a good position.

    The good news is, if you go to pepipoo.com and join, the council forum there has the complete info you will need
    A wrong VRM on the paper PCN is fatal for the council, but that doesnt mean they wont try it on if you dont challenge it and challenge it correctly.

    Hi, me again!  I replied to the BPA as advised AND have emailed Steve Clark who is on holiday but has acknowledged my email and promised to respond next week.  In the meantime, I have had the following response from one of the agents at the BPA to my second email to them...SO frustrating!!

    I understand that your appeal to POPLA was rejected. Our Code stipulates that, if the independent appeals service (POPLA) rejects an appeal, the Operator may continue to recover the parking charge.

     

    Based on the information supplied to us, it seems that you have supplied the driver’s details after ParkingEye started proceedings to recover the charge – I understand that the driver’s details were supplied after the charge had been escalated and a Letter Before Court had been issued to the keeper (yourself).

     

    I appreciate that this may not be the response you were hoping for, but we have been unable to determine a breach of our Code of Practice and we will not investigate further on this occasion.

    I wonder why the comment about not being legally trained - if that is their 'defence' for not understanding the legalities and therefore refusing to acknowledge my complaint, it is ridiculous, surely...
