The contract is in your son's name
So he, or you should phone Orange and just come clean to the extent that the phone is now with his ex and she thinks that she is entitled to make calls on it without paying him back, and he would like the sim card blocked to stop her doing this.
Then all he will be liable for is his line rental until the 18 months is up then he cancels it in the normal way. If he appears to be responsible then they may reduce the debt.

There is no need to lie, just tell them the situation as it is, get new sim sent to your address and they will swap the number over.
Drop the tariff right down after 9 months with orange and pay the bill.
But the op's son needs to do it and he cannot be bothered as they say in little britain, therefore the op needs to ensure her Credit Rating isnt affected.0 -

Thanks for the help.
I sat up last night and did a letter on his behalf to Orange explaining exactly what has happened and asked for time to sort it out. I also did one from myself to the girls mother asking her to ask the girl to have the phone in just her name with my son's agreement and to take the bill on (she was doing this until the last couple of months).
What I can't understand with him is when I said about the sim card being barred or blocked etc he said yes he knew all about that but has done nothing about it!!! See what I mean about from a different planet!!:mad:
There's about four months to run. One of the letters to Orange states that at the end of the 18 months the contract has to be terminated unless she is the person the bill goes to. At the moment she is actually not going overboard with using it. Its just over £125 for two months of calls/texts so it could be a lot worse.
I am also trying to sort out his mess with O2 as well - thats a debt collection agency with that one. Keeping my fingers crossed. I am hoping that they will see sense and accept part of the amount and a reasonable (from my point of view) repayment plan rather than take it to court as its around £450.
Now I've got everything cross. If I knew then what I know now I would have drowned him at birth. I would be out, a free woman now. Fully cured!!!I'm stressed enough over this - please don't add to it.:eek:

All the advice you have been given about this problem you have ignored!
You cannot get the account switched over to someone else.
Writing to Orange is a waste of time - how much more will she have spent by the time the letter gets any action?
You need to get your son to ring Orange today and get the sim card blocked as so many have advised you.0 -
You state that your son does not listen to the advice that you are giving him, but you are doing exactly the same thing here.
Ring Orange TODAY, and get the sim blocked. This way she cannot make any more calls and all your son will be liable for is the line rental until the end of the contract. if you do not she could run up a bill of thousands of pounds and no one could stop her, and your son WILL be liable.0 -

I agree with much that has been said before and how frustrating our kids can be.
Will your son allow you to sort it out? What I would suggest is that he calls Orange and have your name added as third party access (make sure it is added not just that you can speak on that call) in that way you can call at any time and discuss the account with Orange direct. There are a few things that you will not be able to do, one of those to do with the debt is to set an arrangement so that he can spread the cost but you can find out all the details before discussing with your son and then just phoning at a time that he is around when all he needs to do it say - yes.

Unfortunately the OP has come on here for advice but as Quentin and Carly have said, she has not listened.
She is not listening to the consequences of what may happen, and will blow it out of all proportion.
Sons have a bit of hair just above their ear that really hurts if you pull it.
Pour cold water over his head to wake him up, grab that bit of hair and pull him over to the phone. Phone Orange, get that sim blocked, ask for a new sim to be sent to you, ask for the tariff to be dropped to the lowest one possible and pay the bill until he is out of contract.
Simple.
As for his EX. Tell him to forget she ever existed and to get on with his life. It's too short...0 -
Why not just pay off the remaining contract commitment and then file a claim against her for the amount paid from the time she stopped pay to the end of the contract? You do this easily using https://www.moneyclaim.gov.uk.0

Will try the block the sim card if we get no joy with writing to her mother asking for her to get the girl to have her name put on the phone.
I can't sugarcoat this so I won't. It's clear to see where your son gets it from. Block the sim NOW. She could be calling Nigeria for the next week for all you know.0 -

Not such good advice.
Although it's easy to issue a summons, you have to pay to do so, and pay again for a hearing.
So this advice will mean paying out good money to pay off the contract (without getting the benefit of the included minutes etc), plus even more money to issue the summons.
Plus it's no good winning a court case if the Defendant can't pay - it's just a waste of more money in court fees.
And the girl is said to be underage.0
