You don't actually have to have your car repaired, you can sue just for the cost of the repair/damage and NEVER have it fixed. Personally I would get it fixed then sue for the cost.

Nope, I joined after looking for some information and then saw that there were some posts that I can help with. Even if the original poster has resolved their problem - that doesn't mean that other people in a similar situation wouldn't benefit from advice.
