Court Claim received, need a little reassurance that I'm in the right direction

    They are not permitted to advance a claim that isn't in the particulars of claim. 

    The rule about payment is presumably to prevent people parking, going away for a couple of hours and then coming back to the car and then paying for a shorter period, say 20 mins.

    This is not what occurred here and the parking company knows it, since they have a vehicle log and record of payments, which reflect payment for the complete time period.

    ParkingEye v Beavis (which every parking claimant loves to quote) is not a panacea. Its a supreme court judgment, but the charges that were permitted were highly specific to the circumstances.  It's worth looking at the supreme Court press summary to get your head round it, before turning to the relevant pages of the judgment. 
  • Thanks for the advice @Johnersh. I'll have a good read up before the hearing. On reading the particulars of claim again, they only mention that I was in breach of the terms of the signage, thus issuing the PCN. The PCN itself states it is due to not paying within 10 mins. Is that essentially the same implication then, and that's the only argument they are putting forward?


    I've got my DQ now and planning to email it to CCBCAQ@Justice.gov.uk. I got it on the 24th, any time limits? I'm struggling to find the papers they sent due to a toddler, so doing it all online.


    My local court is Lancaster Courthouse. Is there any reason to choose somewhere else, for example somewhere else is known to have more favourable outcomes?

    Missing the deadline is not a good idea.

    150 words on the entrance sign (which says read PDT sign for full terms)
    160 words on the PDT machine sign (which says read signs around the car park for full terms... I know, misleading..)
    300 on each sign around the car park.
    100 on the ANPR notice signs too, which I forgot about.

    I could be justified in reading all of them as the entrance sign says to read the PDT machine terms which in turn tells you to read the signs around the car park.

    So about 700 total.

    yep, 710. Minimum of 3 minutes just to read the signs, never mind find and walk to each one.
