landlord wants to do early inspection

hey

my family and myself moved in to a new property about 3 weeks ago, the rent on the old property is paid up until the 9th december.

the landlord at the old property wants to do an inspection of the place tonight, which is causing problems.

we have moved early to give us a few weeks to move our belongings and to clean the place up before the 9th, we still have a few items there and haven't started to clean up.

I got a phone call off the LL yesterday saying he wants to do an inpection tonight, and we have to hand the keys in.

So today is going to be non stop cleaning and shiftin our stuff in time for 7pm when the place has to be imaculate.

Can the LL do this as we have paid rent till the 9th???

ASLO... he wants our new address, his excuse is past tennants have left there debts and ppl were turning up on the door step asking for the tennant.. we have told ALL our dca's we have moved (not much left to pay, my credit rating is starting to get quite decent so im not gonna mess it all up now).. do i have to give him my new address??? i have been thinking of an excuse to tell him but haven't come up with anything yet.

oh, last q... he has said he will need next months rent (our contract ends 9th jan) as he is going to redecorate top to bottom and he won't get it done till the new year.. im sorry but thats not my problem.. i know in the contract if we leave early we have to continue paying until new tennants move in, but it feels like he is delaying that just to get more money out of us.. aswell as paying 2 months rent for the new place this month (LL gave us a month to pay the deposit to him) we have to pay rent there, we havent got it!!!

    Yes it's fine as long as you don't forget to charge the £100 'early inspection' fee.

    Once you have received that, you are more than happy to oblige.

    Maybe you also want to charge him a £50 'administration fee' to cover giving him your new address?

    He wants to do an inspection on a Sunday night 3 weeks before your tenancy finishes?! Tell him no, he'll have the keys on the 9th December and he can do the inspection then. Then, because the tenancy will be over, he will not be entitled to any rent from you. I'd advise you to take photos of the condition of the property to prove that it's in the condition that you took it on, though, so he can't try and diddle you out of your deposit.

    As for giving him your new address - how will you get your deposit back if you don't give it to him?

    It's your house for as long as you're paying rent on it. Tell the LL to va te faire foutre.

    what a blooming cheek - you're paying the rent, its yours till end of notice day to do with as you want ! - NO inspecton !! - but has he got your deposit ? Have you got a signed inventory ?

    Legally he needs to give you 24 hours notice in writing to inspect the property.

    i have told him no to the inspection tonight, but he wants to go in from tomorrow to start decorating...

    i paid 625 deposit, which i have said take the last months rent out of which leaves him £85, im not expecting to see any of it back... there was an inventory stapled to the back of the contract, but i never signed that page, just the contract..

    Just say NO - he has no right to enter your house (without 24 hours notice in writing to which you have agreed) before the contract comes to an end. You are the occupants until 9th Dec, he has no right to disturb you in such a way, and certainly no right to demand the keys back or to inspect until 9th Dec. He hasn't got a legal foot to stand on with this one, so don't give in - stick to your guns, you are absolutely in the right to hold the keys and wait for inspection until 9th Dec. And if he turns up tomorrow wanting to decorate, do not let him in (does he have keys?). If he lets himself in, you can probably sue him for breach of contract.

    As for wanting rent up till 9th Jan, I'd tell him where to go, honestly - you are only liable for the rent during the contract period. Again, he can ask all he wants but he has no legal backing for that, if the contract ends on 9th Dec then that is when you pay rent until - no longer.

    I think it's a good thing you're getting away from this landlord, he sounds like a bit of a turkey!

    So you are contractualy obligued to pay rent for the property upto 9th Jan....i.e. you last rent payment is due 9th Dec.

    Therefore the house is legaly yours upto and including 9th Jan.

    Therefore you don't need to hand the keys back and provide final inspection until around 8/9th Jan.

  • It may well suit him to get the decorators in tomorrow, but it doesn't suit you. If your rent's paid until 9 Dec (however he's getting it) & he's getting the final month's (to 9 Jan) from your deposit, he's got a few weeks yet until he can start wielding a paintbrush & he'll just have to wait until then. Legally, you could still be living in the place.

    There are many great landlords out there, but some do push it. An ex-landlord of mine tried a similar stunt. Our rent was due on the 1st of the month, & when we decided to move, we gave him three months' notice though he was only due one. From the moment we gave notice, the landlord who even the agents had had difficulty contacting became a total nuisance, ringing up giving us only a couple of hours' notice of viewings, scheduling some when it would mean we'd have to take time off work etc, & being extremely rude when we weren't happy about it. :( The final straw was when he told us on a Wednesday that he needed us to be out for a weekend at our expense five weeks before our moving date so that he could inspect the place, sort out what repairs & decorating needed doing & make a start on it. :eek: We got a solicitor friend to write to him & the agent reminding them of the terms of the rental, & emphasising the notice he had to give us. She listed all the access we'd given him & the notice he'd given us, the many times both we & the agent had had difficulty contacting him re repairs etc. She advised him that in view of that, he would be getting no more access until our agreement ended, & would be expected to take the deposit as the last month's rent. If he felt that was unacceptable, we would look to bill him for the previous repeated invasions of privacy & breaches of the agreement, & any future ones. She also informed him that we had taken date-stamped photos of the property as it was on the day we moved in & had a copy of the signed inventory, & would be taking photos of the property when we left it. As he would be using our deposit for the last month's rent, there was no need for him to have our new address. We received a curt telephone call from him asking us to confirm our moving date, we handed the keys in to the agents on our last day with copies of date-stamped photos we'd taken & never heard from the landlord again.

    Stand your ground. You're paying rent, & the place isn't his to do what he feels like with until the day your rent expires unless you feel like giving him the property sooner. He'll just have to wait.

    OK, so the house is yours till 9th Jan? I missed that! In that case he cannot take possession of the house or conduct an inspection until then, if that is when your contract ends. Do not let him in if you can stop him, and make sure you assert your rights. What an awful landlord!
