While there is no formal time limit, if they let it go for years that can be considered unreasonable.
  • Update on this case: Although I was informed by the central court that my claim was stayed I have now received a form N159 (Notice of Allocation to the Small Claims Track (no hearing) from my local county court.
Is the standard advice still not to accept a hearing on papers only? The wording states that the judge proposes that the case is disposed of without a hearing.
    Any advice gratefully received.

Stayed means just that - on hold - no surprise that is is allocated now. Absolutely a NO to a hearing on papers.  Look what happened over the last couple of days to two posters who elected to go to hearing on papers; they lost!
  • Thanks for the advice!

The TELEPHONE HEARINGS thread has the words to use that I posted there in June (it's in the middle of the thread - p10 maybe).  People who agree for a PPC case to be heard on the papers, lose.  Be warned it is vital to say no.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
