[UK Parking Patrol Office / BW Legal] Claim stayed

    Giving a deadline to respond to a LBA is utterly normal. 
    Im more talking about the court process, and that the suual sanction for a C failing to meet deadlines is a stay. relief from sanction would mean tey didnt have the stay to lift.

    Ah, even more reason why I think it will continue.  It's probably the backlog at the CCBC that's delaying it and the clerk you spoke to was guessing.

  • The court emailed me and confirmed that the claim is now stayed and that the claimant will need to submit an application to lift the stay so I hope that the clerk didn't just take a guess, but yes it could be due to a backlog.
    The claimant did not give me a deadline to respond to an LBA as such but gave me a deadline to pay up before they proceeded further with the claim (in this case 13th April) after they had received my defence. Hopefully I will receive clarification as to why the claim is stayed soon.

    Do not forget that BWLegal has already tainted their claim in their LBA by adding a fake £60 making any statement from them unreliable
  • I received this from the court this morning. 

    The claimant had 33 days from receiving  your defence to respond to it.
    We haven't heard from them and the case has been automatically stayed.

    Is there a maximum time that a case can be stayed for before the whole thing goes away?

    Unless they already have and the court is wrong.  Just want to be cautious here because we've seen cases resurrected.  Don't throw the paperwork away.  Put it in a drawer and enjoy the sun, though!

  • Thanks for the input everyone. I will forget about it for now but keep hold of all the paperwork. It seems strange that the claim is on hold indefinitely, surely there is some kind of time limit.

    No, this does sometimes happen but so do cases rearing their ugly heads again, when the PPC tell the court they did respond after all.  There is no time limit...the stay might just 'stay'!
