    Saying something whilst knowing that it can't be proven that you said it is one thing, going on the record in writing is something different entirely.

    I know from experience that once Mercedes have sold you a lemon they really don't care.

    They share the philosophy of Jaguar and Audi in believing that as their products are expensive they are faultless.  They aren't.

    If you can set up recording equipment in the car so you have evidence of it happening.

    Was it a new car, and have you let Mercedes UK (not just the dealer) know about the problem? If it was new and is under Mercedes warranty contact them and explain everything, you might be best writing it all out (include dates) so you have a full account of everything. If the engine is cutting out it should be leaving an error code in the ECU that any competent garage, let alone a Mercedes dealer should be able to access and it should give a good idea as to the issue.

    New car I got last year in April. Its still under warranty. Apparently their is no error code left on the ecu and apparently each time their is an update every time it goes back to get looked at

    Since this is under manufacturer warranty, just take it to another MB dealer, if you've lost faith in that one.

    Not Mercedes but my daughters mini had the same fault under warranty about 3yrs in kept cutting out on motorways constant trips back and forth to BMW ,however it cut out one day  with a police car behind they followed her to the hard shoulder my daughter was upset ,they escorted her to the BMW garage they spoke with them  and a new mini of her choice plus 3k  was arranged .Keep pushing it took her nearly 3yrs .

    It turned out to be the crankshaft position sensor. I gave them a rocket, I was furious. They sent me home in a dangerous car.
    No they didn't. A car that can inconveniently have the engine cut out that can still be steered and stopped, albeit with a little more effort required on the steering and brakes yes but it isn't dangerous. Dangerous is defective brakes or steering or a wheel falling off or a bald or bulging tyre.

    Yes, that's my feeling too.  I wouldn't get side-tracked into a debate over whether ot not the car is dangerous, that's not really the issue here is it?  Randomly conking out is the issue, concentrate on that.

    Also, do we really believe it's a software update issue?  I seriously doubt your Merc is running a unique version of software so why are loads of other similar cars not having the same problem?  If they were then it would be a manufacturer recall issue.

    I suggest that you detail the issues to Honest John who has a section in the Daily Telegraph. If he hasn't come across the problem he will find someone who has. He also has contacts within the motor industry to follow up issues like yours.

    The one and only time I had a repair done under warranty the dealer tried to charge me. They said they don't get paid a penny from the manufacturer unless they send them a faulty part. If that was the case a dealership might spend hours trying to diagnose an intermittent fault with little chance of sending the manufacturer an obviously faulty part. Is that how the system works?
