Car accident... Who's fault?

There was more of a duty for you to have been checking your mirrors because you're the one reversing.Duckkyprime23 said:
Because she was pulling out of a car space onto the road where there could be traffic either way?KimJongUn88 said:
Why would she need to check her mirrors if she was driving forwards and not changing lane?Duckkyprime23 said:She wasn't approaching tho, she was parked at the side of my car. Whilst reversing she pulled out. Shouldn't she have checked her mirrors to see anything was coming down the road behind her?
Every single person who has responded on here has advised that you were at fault. You asked for people's advice an this is what they've said yet you won't listen to anyone.0 -
Yes, you said you checked before reversing. The question was where were you looking while actually reversing? You should be looking out of the rear window.Duckkyprime23 said:Checked all mirrors then reversed, yes she was pulling out the opposite way to what I was reversing.

Insurance companies will nearly always put the blame on the person reversing.
Up to you to make sure everything is clear etc. She pulls out you are still liable.0 -
Struggling to figure how a car that was alongside you whilst you were parallel parking got hit- maybe I’m being spacially challenged today1

I'm struggling with the same thing.ToxicWomble said:Struggling to figure how a car that was alongside you whilst you were parallel parking got hit- maybe I’m being spacially challenged today0 -
The street is a narrow street with the road only being wide enough for one car at a time, I was reversing to go into my space outside my house, as I reversed she pulled out of her space.DoaM said:

which part of your vehicle came into contact with which part of hers ?
are you saying that had you remained stationary in the middle of the road she would have just pulled out and driven into you ?
sounds like a 50/50 to me if she pulled out straight Into the path of a reversing vehicle

So the damage is the rear of your car and the front of the other car. Or is it on the side? As you reversed you checked that it was clear, it was clear, then did you see the other car, you would if you were looking.Surely, at reversing speed you should be able to stop with 3/4 feet?

Yeah the damage is to my passanger rear bumper, hers is to the front passenger side door. I was definetely looking and about to turn and swing into the parking space. By the time I realised it was too late I'd tried braking but collided. I've read thar claims usually don't bode well for the person reversing but I thought that before pulling out of her space, she should have at least checked nothing was coming either way before pulling out, if she had she would have seen I was already reversing into the parking spot. Thanks for all the replies btw.ElephantBoy57 said:Duckkyprime23 said:The street is a narrow street with the road only being wide enough for one car at a time, I was reversing to go into my space outside my house, as I reversed she pulled out of her space.I too would say that the car reversing is at fault.
