Car Accident - Council denying liability

I don’t understand.
You were on Hamilton Street turning right at the lights (onto the A577 towards Manchester) Another car was coming from the opposite direction (Kay Street) also turning right (away from Manchester). Why did you have to move so far to your right that you hit the island crossing?Even if the bollards were missing surely it would have been visible?1 -
That's quite a wide lane. Where were you off to so to be so far over to hit that?0

dacouch said:Adrian gave you the correct answer earlier, if the council inspected the road at the required interval then you have no claim against them.
To damage your car on that you must have been going reasonably fast as hitting that at a turning speed of 10 - 15mph would not do much damage to your carOk I will take this into consideration. Buckled wheel and broken plastics not a major problem but still won’t be cheap to fix.0 -

I'm sure most drivers would readily see at night a moving upright pedestrian when making this turn, but perhaps not all of them would equally notice a motionless pedestrian wearing dark clothing lying flat in the road.

When turning the crossing was in my blind spot near the drivers side wheel I didn’t fully drive over the whole thing only the driver side went over it. If the bollards were there like they should have been, this wouldn’t have happened?ThanksYou've got no chance. You were paying absolutely ZERO ATTENTION to hit those. They're as plain as day to see. ot only that, NOBODY CUTS CORNERS THAT MUCH when turning into a side road. They are WAY back from the road you turned right from. Regardless of the bollards being there or not your car shouldn't have been anywhere near that island. I drive lorries, they're 53 feet long and even my lorry turning right at that junction wouldn't have been near that island.Your driving is truly shocking if you didn't see that and you think the path you took to turn right was a reasonable one.0

I was turning from one road onto another road, a car coming from straight ahead, I was turning right and so was they obviously both opposite ways. So I had to move over towards the right. If the crossing didn’t need bollards they wouldn’t have had them there in the first place, so they are clearly there for a reason?0

You would have had more of a case if it had been a proper bollard that was illuminated. They say the camera never lies so why didn't you see it, lack of attention?0
