Shearings going into administration - how to get refund

    I would complain to your bank it should be the other way round,  if the Chargeback fails, then look at the other options.
    New User name as MSE gave me a number in my old one.

  • I have a credit note for a full holiday that was cancelled this year before the company went bust, can I claim a chargeback from the bank for the value of this as the credit note is now worthless. The bank is umming and arring over this any advice ?

    I had no problem raising a section 75 claim with Santander. The holiday was booked directly with National Holidays and paid by a Santander credit card. There was no credit note issued as the holiday was planned for late June and was still “going ahead” when the company went bust.

    The bank accepted the s75 claim, but are trying a chargeback first (their decision, not mine). They said the process could take 8 weeks... no update from the bank since.

    Reading the various documents from the administrators, they appear to avoid mentioning the bond/fund that is supposed to cover any monies paid, maybe it is under funded and worthless?
  • I booked self drive holiday direct with Shearings web site have done so for years, was saddened when company went bust. I was issued a credit note firstly due to Covid then emailed later to say company out of business. I was not happy as Shearings informed me that my was holiday was covered and not to worry when issuing credit note so thought no more about it.
    When hearing company had went bust, tried emailing administrators who informed me as I had paid by Visa Debit, I was not covered as first informed but to raise a refund, I must go through Bank. It also claimed as I had not booked ''travel' but was self driving, I was not covered.
    I spoke with my bank who took my details Lloyds debit card and advised I had to wait 45 days for a response. The 45 days are now past and have tried emailing them without a response. 
    Can anyone advise if having the same run around as I'm having?

  • I booked my holiday through a travel agent and i am still waiting for my money. The travel agent said that i have to claim through my bank , but my bank will not reimburse me because on my bank statement it does not say shearings . It say the travel agents Name. I have been fighting with the travel agent for 5 months now.  
  • After 8 weeks, Santander wrote saying that I had to forward all correspondence. I replied stating that I had previously sent everything I had. Two weeks later, I received a full refund via the bank.
  • Cardon, the travel agent is giving bad advice because if you did have a successful claim against the bank, it would be their back account that would be debited. You need to contact Bonded Coach Holidays, you can download the form here http://www.submitaclaim.co.uk/shearings. It would have taken the agent 1 minute to have done that for you, so next time maybe chose a different agent!
  • Advice needed please ! My Mum and her friend booked for a coach trip with Shearings ( via a travel agent ) to travel in March , which was obviously cancelled due to Covid. My Mums friend actually booked it and was the lead name ( my Mum just sent her a cheque for her share of the holiday ). Both my Mum and her friend are elderly and apart from not using the internet maybe would not be savvy about researching what rights they have etc. 6 months later still no refund and when they speak to their travel agents , the agent says they are not responsible but have filed a claim for on their behalf with Shearings and they just have to wait .....

    If they paid the travel agent then the travel agent is responsible for the contract so if the contract can't be delivered then the travel agent is responsible for issuing a refund.

    Did your mum's friend pay any part of the balance by credit card?  If she did you could look at whether a section 75 claim could be made.
