Shearings going into administration - how to get refund

    Firstly my Mums friend paid by debit card so no cover there im afraid.
    I have been in contact with the travel agent direct ( Baldwins Travel ) and have spoken to the manager at the local shop where the holiday was booked . I had already checked that they were ABTA covered and they have confirmed that all they have done is open a claim for a refund through the ABTA site  (set up to assist customers to obtain a refund from Shearings) . I have been on the ABTA website and we could of done this ourselves . The shop manager insists that it is not upto Baldwins to issue a refund and says she is phoning the claims line every week to chase my Mum / Friends refund but these things take time. All i get told is it is being reviewed by a claims handler ?
    So i am left with still not refund from either the Travel Agent or ABTA from a holiday that was paid in full at the beginning of March ? I dont know who to complain to now to try and get someone to take responsibility. Any more help / advice would be much appreciated

    The travel agent is correct, the contract was with Shearings not Baldwins but ABTA are not processing refunds at all. The company was bonded through the Bonded Coach Holidays scheme which has nothing to do with ABTA. The correct place for information is here: http://www.submitaclaim.co.uk/shearings. It is that simple!
  • Alan_Bowen - Thanks for your reply. However , its not as you suggest ' simple ' . The travel agent have submitted a claim via the ABTA site. Are you now saying that i should use the link you provided to make a seperate claim ? Or would this be basically the same refund application but via another link ?

    Isn’t your claim against the company you paid, ie the one stated on your card statement.
    In my case I dealt directly with National Holidays, which resulted in a straightforward claim via my credit card.

  • Frozen_up_north  - Thanks for your reply. My Mums friend paid on her Debit Card direct to Baldwins Travel for the holiday , so we cant claim via a credit card like you did.

    ABTA simply aren't dealing with Shearings Holiday claims at all, so your agent will be waiting a long time for a reply. Go to the website I mentioned and get the claim going ASAP. ABTA only deals with failures where they hold a bond, in this case Bonded Coach Holidays protected the coach holidays despite Shearings being a member of ABTA
