It had a 30 day 'no quibble' exchange policy.
Caveat - for a car of the same value or greater, in stock at that dealer. The OP says he wanted to exchange for a cheaper one.The OP was worried because it was the start of lockdown and he was worried about losing his 30 days.
And was given assurance that the dealership would honour it post-lockdown.All he got was the used car salesman "Nah you can't get your money back. Go away. Most brand new cars are crashed and repaired".
And that is two simple statements of fact...
1. We know nothing about the extent of the damage. BUT we do know that the OP did not notice it when inspecting the car prior to purchase, or on collection, but only when he inspected the car very closely, potentially far more closely than any normal owner. That is not grounds for a CRA2015 return.
2. Not most. Nobody has said "most". The usual statistic quoted is around a third of new cars have some bodywork damage. Is transit damage the same as "crashed"? Not in the usual layman's meaning of the term, no. It may be scrapes and dings from ratchet straps and the like. The body work was noticed within an hour of getting the car home and should have been picked up on a comprehensive 142 point check.
Did you look at that checklist? Have you seen the damage in question? Do you even have a description of it...?
But, of course, it's all academic, since the dealer has accepted a return of the car, and returned the OP's money in full.1 -

Come off it, I work with these blokes day in day out (the highly trained factory "technicians"
).
Yes, there is a certain level of skill involved and experience plays a large part, but they don't possess anything special that can't be picked up by most people with a little training.

We said he wasnt legally obliged to reject the car based on it have had a wing repainted, which is correct.
The dealership did as was committed to over and above their legal requirements - they took the car back.
