PCN

Good evening,

We were surprised to receive the below PCN. If matters, it does not state the maximum parking allowance or how much did we overstayed.

We examined the signs and they do display 90 min allowance. Therefore it seems the overstay was approx 16 min.

Any overstay was unintentional due the coronavirus shopping measures. We visited only two stores in the retail park and had to await in the

ridiculous long queue for more than an hour just to collect some goods (Click and Collect) from the 1st shop and rest of time time was spent in the 2nd shop.

We have shopping receipts to prove.

Where are we standing with this PCN?

    simple , read the NEWBIES FAQ sticky thread

    first stage is COMPLAIN to the retailer or landowner and get it cancelled at source, because what happened here is bound to happen due to the new slower queuing system , use the royal WE when dealing with them ( WE shopped , WE were delayed due to your C19 restrictions etc)

    was it Morrissons ? if so complain to David Potts , the CEO, same as everyone else has done

    if it is a retail park with multiple outlets , complain to the Managing Agent asap

    stage 2 is to appeal it with the blue text template within the 28 days allowed for appeals, so say 25 days after the date on that pcn, appealing as keeper

    no blabbing about who was driving

    You just add the above facts to the appeal (change the wording in the middle of the usual forum template appeal) and the receipts, like the NEWBIES thread already tells you to do.

    And complain to the retailers (again, the sticky thread tells everyone this is Plan A and that the Store Managers or the retail park Management can cancel this easily).

    No need for a thread about it but seeing as you started one, please do tell us when  Plan A or Plan B works.

    Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully, when life gets back to normal, it will become impossible for those scammers who are left to continue their vile trade, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

Apologies for posting the question despite documented procedure on newbies sticky page. We were just unsure where are we standing with the C19 restrictions.

    HI Redx,

    Almost made a mistake and sent complaint to ECP.  We should sent them only the blue template, right?

    We don't know who is the managing agent for the the retail park. On premises are only two shops; Home Bargains and Halfords. From what you say we should complain directly to the stores CEO's and give the mitigating circumstances?

    No, you should complain to the stores (as high up the food chain as you can get) and insist that they have the PCNs cancelled on the basis that you were a customer but, if every shopping trip comes with a £100 surcharge, you will be an ex-customer as will your family and friends.

    We don't know who is the managing agent for the the retail park.
    And we don't know either.
    If you were to say where exactly this dastardly deed took place someone may know.

    The council will know who pays the non domestic business rates

    The land registry will definitely know who owns the land

    But before those are tried , try Google and also tell us where it is , because you won't be the first and finding out isn't as difficult as you think, would take Poirot 5 minutes

    Try complaining to both retailers too , because they will know who collects the rent , so think outside the box , be proactive , don't put it in the too hard pigeon hole

    Yes use the blue text template as keeper , you are appealing to Ecp , you are not complaining to Ecp
