POPLA appeal help, please - ParkingEye for a 10 minute overstay, plus NTK question

    Hmmm, I looked and it seems more likely Home Bargains might own this land...have you complained to the CEO?

    I specifically asked the Store Manager if they own the site - he said no, we don't. But even if they do, it does not matter as he said he could not do anything. I thought he lied but then found that he was just following orders. So I don't believe actually ParkingEye have been appointed by Home Bargains. I guess I will only know when I have seen the Store Manual, or contract with landowner. But either way, it would appear that my stronger point is that the POFA cannot be applied as the NTH was not served correctly.

    I think they may well have, and I say complain to the CEO of HB, first, waaaaay before trying POPLA (last resort - and possibly likely to lose).  What makes you think this is one of those car parks in that link?  I would assume it's not.

    Tell the CEO of HB that you know that retail clients who engage ParkingEye, have a USER MANUAL with a direct cancellation email for these cases and you are most unhappy that the Store Manger refused.  And you have no reason to think this car park is not owned by HB or that they didn't contract with ParkingEye, and you need them to please step in, and cancel it before you are sued.

    Attach proof of family spends over the past months/year at any HB (any family bank statements you can drum up to support the complaint - make a real effort to show you are genuine customers and are horrified, and are thinking of boycotting the stores in future, etc.).

    I like this! I will write to HQ in Liverpool. But why not file the POPLA appeal in the meantime? The CEO might never reply, or be late and I would miss the deadline for appealing. Can the PCN be cancelled by a retailer after it is rejected by POPLA?

    Because P/Eye will not cancel if POPLA has cost them money...this has been said and done here sooo many times before.   We know what we are doing on this forum and doing POPLA first would be FATAL to the complaint.

    This is why I told you that POPLA codes last 33 days...you probably have time.  And you could (if you have to by day 33) just file a single paragraph holding appeal that won't cost P/Eye anything. 
    But DON'T even do that yet, not first.

    Store managers prove unhelpful, or indeed, 'economical with the truth' time and again.  It's almost as if they attend special 'Fobbing Off' training sessions because the script is always so similar.  I think anyone who contacts an onsite manager should have their email to the CEO written and good to go just in case.

    If they have a website/Facebook page, can you not write bad stuff on it?  
    You never know how far you can go until you go too far.

    Thank you for getting in touch.
    I am sorry to read of the problem described below. Unfortunately this car park is controlled by Parking Eye and we therefore have no control over the parking restrictions that have been put into place.
    In order to appeal your parking ticket you will need to contact Parking Eye directly. You can either appeal by letter to:

    Parking Eye
    PO Box 565
    Chorley
    PR6 6HT

    We have no control over who tickets are issued to, nor do we receive any money from the tickets.
    I am sorry I can not be of any further assistance on this matter.

    I have replied asking who owns the car park and therefore authorised ParkingEye to manage it.
