He definitely lied but perhaps his handbook told him to fob people off rather than help.

No it doesn't, it's called a User Manual and it gives all P/Eye clients the right to cancel - DEFINITELY.

Your issue seems to be you have been assuming that's Home Bargains when it's possibly not them, it's whoever runs the car park/retail site itself, and that's usually a property agent like Savills, who you can find an email for the person responsible, just by Googling the name of any retail park...and look for adverts from property agents about the retail units.  That's your person.

If it's not Home Bargains. then it's the managing agent you find by Googling.  Your task for this week is to find out who took on ParkingEye - and they will cancel, if you persist.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Coupon-mad, excellent points! I do not live anywhere nearby the car park, have only visited once to take photographic evidence of the broken barrier and any signage that shows print too small to read from a car, confusing /unclear terms, etc and not keen to visit again but will check all property agents and google, as you suggested. The signs say "For use by Home Bargains customers only", which I assumed to mean that it was HB that appointed PE but again I missed the obvious, thank you for pointing it out!
  • Hi all, ready to post my draft but it is rather long (having elaborated on all the additional points!). Do you mind if I post the full version here (editing out identifiers), or shall I just post the summary?
One technical question - in the pdf file that I will submit to POPLA, should I include my own photographic evidence (showing illegible signage) and scan of the PCN (that shows conflicting arrival times, for example), or shall I leave it for the part where I comment on the evidence provided by ParkingEye?

If you want to use your own photographic evidence, you must include with your appeal. You cannot add evidence later - just comment on the operator's evidence or lack thereof.

Have a look at those sample PoPLA appeals linked from the third post of the NEWBIES thread. Some of them run to twenty-odd pages - with pictures embedded at the appropriate points.

I would hold off completely with that, and just put in a holding appeal due to the pandemic and pursue Savills for as long as it takes to get cancellation:

Thanks for this, not surprising after everything I have learned about this "industry". However, my appeal is ready. I will put your disclaimer on the bottom (the one you suggest on the other thread) but why not send the full "working copy"? I am not sure if it is Savills that own the site and not sure if I will ever find out. Google gave me no clues and there is no other shop unit there to check for owner details.

What's the name of the retail park?

Home Bargains, Oakwood, Leeds - 639 Roundhay Road, Roundhay, Oakwood, Leeds LS8 4BA
On Google Maps, it is behind Home Bargains, off the side road.
  • What's the name of the retail park?
It is not a retail park - from what I can see, it is only a unit. Oakwood Solicitors are right next to it but their car park is entered from the main road, i.e. is separate from the Home Bargains car park
