CIFAS dispute

Hi, I’ve just discovered from a subject data access request that a CIFAS marker was placed against me which I know is incorrect and wanted to get some help. The case type was Identity Fraud and the reasoning was Impersionation - Current address fraud. It was placed by a loan company whom which I had applied years ago, on more than ocassion.

I can see that from the report that the name on the application has some two spelling typos and the date of birth has one error in it. I appreciate that this was my fault during the application and should’ve paid more attention but it was negligence on my part and can’t blame anyone else for that. 

I have already sent in a complaint to the lender as although there were errors in my application form and my application was subsequently declined, I strongly feel as if the marker was incorrect as I did not act fraudulently. I did not try impersonating anyone else.

If anyone can give advice, I’d be extremely grateful as I’m worried about the detrimental effect this marker will have on me.

  • In the business world that lack of attention to detail has an impact as you're discovering, any business related information needs to be squeaky clean or it will indeed impeed financial services offered and impact your file history for years. 

    Other members will have some detailed knowledge on possible strategies to extricate yourself so be guided by them on the steps forward from it.

    They wouldnt give you a CIFAS marker for an error on an application form. Seems an fix. Was this a payday loan i am assuming?

  • Hi, it was for Satsuma Loans. I applied in 2018 and only discovered the marker now due to the subject access request. The marker was placed under my name but with my a grammatical error and my year of birth wrong. I’m guessing it’s due to that reason they put Identity Fraud - Impersonation.

    very unlikely they put down a cifas marker cause u put the wrong date of birth. give the real story here

    Did you have any history with Satsuma, such as having had loans before, or any late payments or defaults?
    If you’ve used them before and then reapplied with your details changed then it would definitely seem suspicious.

    They would not give you a cifas marker because of this. Firstly because when you applied you and typed in a wrong DOB they simply would not have found you in their credit search and thats as far as it would go. End of application. 

    Secondly, if you already had a loan before then applied again with a different DOB, sure looks a little dodge but not enough to warrant a CIFAS marker. Must be hundreds if not thousands of people making genuine mistakes on application forms all the time. 

    Again i believe something is missing from this story. If there isnt, simply complain to providential and ask them to remove the CIFAS as you put in your DOB incorrectly as a typo

    There are a range of different CIFAS markers, some more serious than others, so it's not helpful to insist that OP is wrong when they say that they were given one shown as "The case type was Identity Fraud and the reasoning was Impersionation - Current address fraud", and OP admits there were two errors with the name as well as one with the DOB.

    I couldn't find a definitive current list of marker types but posted this old one yesterday on another thread - it seems perfectly plausible to me that the description given by OP is an updated version of one of these:

    0 Protective Registration -- Recorded at the request of the person named.
    1 False Identity Fraud -- Use of a false name with an address.
    2 Victim of Impersonation -- Use, by another person, of this name and/or address.
    3 Application Fraud (Facility Granted) -- Use of name reasonably believed to be genuine, but with one or more material falsehoods in personal details or other relevant information -; the facility was granted.
    4 Application Fraud (Facility Refused) -- Use of a name reasonably believed to be genuine, but with one or more material falsehoods in personal details or other relevant information -; the facility was refused.
    5 Conversion -- Conversion (disposal or sale) of goods (to which the hirer/buyer does not have title) under a hire purchase, conditional sale, contract hire, leasing or rental agreement.
    6 First Party Fraud -- Opening an account or other facility for a fraudulent purpose, or the fraudulent misuse of an account or facility.
    7 Aiding & Abetting -- Aiding, abetting or assisting, or conspiring with, another or others to fraudulently procure credit, or other facilities, or hire products or services.
    8 Insurance Claims Fraud -- The making of a claim(s) under one or more insurance policy (ies) with one or more material falsehoods or by presenting a false or forged document.

    Very unlikely to happen though as i said. This an easily be sorted out, just an email to providential and they will sort out the mistake. I would assume it would be application fraud (refused). Could easily be identity too.

    You can get a CIFAS marker for entering incorrect data on an application form the same way you can get a record on National Hunter for providing false or incorrect data on an application.
