Looks fine as long as there were no white lines telling drivers to park differently.  As usual, it's a scam but PPCs have discovered that abusing the court process is a cheap form of debt collection and intimidation.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

There are no lines at all. I moved my car and took a picture of the whole kerb (thank you Umkomaas :) ).

The (admittedly hard to see) plaque is just to the right of the green bush.

So is there just a single plaque? How does that give any idea of where the vehicle needs to be parked? Ie what is the extent of the "£bay" this creates?~
Id supply the photos you have and point out theyre talking crap, and they have to cancel the charge and ceraser, as they no longer have reasonable cause to process your data. Or some such.

Indeed, there is just a single plaque. I have already supplied them with the pictures when I went through their appeals process, but they replied rejecting the appeal, of course. I am going to write an SAR to them tonight, asking for all my documents, and perhaps will follow up with another email doing what you suggest.

Point out to them that as the principal they are fully responsible fgor the actions of theire agent, and that if they refuse to insdtruct them, to cancel, you will have no choice but to enjoin them to the legal actiron you will take against them for breach of lease
BUt again, need to see your pictures of wehere the car was actually parked, as we still havent any idea.
I would change that to reminding them that they are jointly/fully liable for the actions of thier agents (link parking)
Tell them that whatever contract they have between themselves and link parking is of no consequence to you
(give them a get out clause)
Tell them that if they will issue a statement to you stating that they ( the management company) do not want this matter proceeding through the court, wasting valuable court tme and resources, particularly at this time
, then you will be prepared to re-consider having them joined to the case.

You should also state that you are surprised that they have said they can not get invovled, as you also have a strong suspision that there could be a breach of the GDPR regualtions, in that as you have a pre-exisiting right to park - no reasonable checks would have taken place to ensure that they/their agents had the right to access your personal data, and then continue to process it once it was known the address of the registered keeper was linked to the car parking space/area.  GDPR also introduces personal liabllity where an individual can be held peronaly liable.
again remind them that they are jointly and severally liable for the actions of thier agents.

THe above should give you an idea on a few points on how to proceed, personally i would go for the trying to get a statement from them withdrawing support, if you get theis you must then tell the pakring company and instruct them to withdraw

And yes, I'll have to make sure to use British spelling of words, haha
It's not that it is the British spelling; "curb" has a different meaning to "kerb"

Curb and kerb are just different spellings for the same thing, I believe. Granted, curb has other meanings as well.

You need to read that article properly, curb is American/Canadian English whilst kerb is English/Australian English B)

Yeah, I tend to use American spelling, which is why I was using the word curb, and why I said that going forward I should stick to British spelling if I'm going to be dealing with the British legal system haha
